KILLYBEGS FISHERY HARBOUR CENTRE (RATES AND CHARGES) ORDER, 1978.

I, BRIAN LENIHAN, Minister for Fisheries and Forestry, in exercise of the powers conferred on me by section 4 (2) (b) of the Fishery Harbour Centres Act, 1968 (No. 18 of 1968), and the Fisheries (Transfer of Departmental Administration and Functions) Order, 1977 ( S.I. No. 30 of 1977 ) (as adapted by the Fisheries (Alteration of Name of Department and Title of Minister) Order, 1978 ( S.I. No. 195 of 1978 )), and with the consent of the Minister for Tourism and Transport, hereby order as follows:--

1. This Order may be cited as the Killybegs Fishery Harbour Centre (Rates and Charges) Order, 1978.

2. This Order shall come into operation on the 26th day of September, 1978.

3. In this Order " fish " has the same meaning as in the Fisheries (Consolidation) Act, 1959 (No. 14 of 1959).

4. Each rate or charge specified in column (3) of the Schedule to this Order at a particular reference number is hereby fixed as the rate or charge for the use of the facility or service described in column (2) of the Schedule at that reference number.

5. (1) A rate or charge fixed by this Order shall be paid to the Minister by the person using the facility or service concerned.

(2) Failure to pay the amount due in respect of such a rate or charge at the end of the period of one month beginning on the date of written notification to the person concerned by or on behalf of the Minister shall render the person concerned liable to payment of twice that amount.

(3) An amount due under this Order may be recovered by the Minister either as a simple contract debt in a court of competent jurisdiction or by distress and sale of any ship, boat or goods in respect of which the amount is due.

(4) In this paragraph "the Minister" means the Minister for Fisheries and Forestry.

(c)

if boat is 75 ft. or over but under 100 ft. in length

£1·20 for each entry into harbour, or £24 for each year payable in advance on each October 1st.
(d)

if boat is 100 ft. or more in length

£1·20 for each entry into harbour, or £30 for each year payable in advance on each October 1st.

Use of harbour in connection with cargo of fish--

fresh fish

fish for reduction to fishmeal

6p per 50 kgs.

3p per 50 kgs.

Use of ladder

60p each entry into harbour.

Use of electricity

60p per hour.

Use of harbour landing facilities or associated land areas for washing fish boxes

£2·40 per day.

Use of fresh water

48p per tonne.

Use of hose

24p per occasion.

Rope money

£9·00 per trip.

Use of berthage or moorings provided by harbour authority for purposes other than loading or discharging

4p on every tonne of (a) the net Register Tonnage or (b) fifty per cent of Gross Tonnage, whichever is greater.

Use of berthage or moorings provided by harbour authority for loading or discharging

12p on every tonne of (a) the net Register Tonnage or (b) fifty per cent of the Gross Tonnage, whichever is greater.

Use of harbour by vessel laid up at pier, quay, berthage or jetty

(a)

For the first two weeks the rate of charge at reference number 9 above is applicable.
(b)

For every day after two weeks and up to the end of the fifth week, 8p per day per metre of length of boat.
(c)

For each additional day after five weeks 15p per metre of length of boat.

Use of harbour in connection with miscellaneous cargo:--

(a) cured or salted fish 3p per barrel.
(b) salt 4p per tonne.
(c) empties 2p each.
(d) solid fuel 6p per tonne
(e) manure 12p per tonne.
(f) large animals 10p each.
(g) small animals 5p each.
(h) other cargo 24p per tonne.

EXPLANATORY NOTE.

This Order specifies revised rates and charges to be paid to the Minister by persons using the facilities at Killybegs Fishery Harbour Centre.
