S.I. No. 114/1981:

WIRELESS TELEGRAPHY (BUSINESS RADIO LICENCE) (AMENDMENT) REGULATIONS, 1981.

WIRELESS TELEGRAPHY (BUSINESS RADIO LICENCE) (AMENDMENT) REGULATIONS, 1981.

I, ALBERT REYNOLDS, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by section 6 (1) of the Wireless Telegraphy Act, 1926 (No. 45 of 1926) and with the consent of the Minister for Finance, hereby make the following regulations:

1. (1) These Regulations may be cited as the Wireless Telegraphy (Business Radio License) (Amendment) Regulations, 1981.

(2) The Wireless Telegraphy (Business Radio License) Regulations, 1949 to 1980, and these Regulations may be cited together as the Wireless Telegraphy (Business Radio License) Regulations, 1949 to 1981.

(3) The Regulations shall come into operation on the 1st day of April, 1981.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. In these Regulations--

"the Regulations of 1949" means the Wireless Telegraphy (Business Radio Licence) Regulations, 1949 ( S.I. No. 320 of 1949 );

"the Regulations of 1956" means the Wireless Telegraphy (Business Radio Licence) Regulations, 1956 ( S.I. No. 2 of 1956 );

"the Regulations of 1957" means the Wireless Telegraphy (Business Radio Licence) Regulations, 1957 ( S.I. No. 181 of 1957 );

"the Regulations of 1980" means the Wireless Telegraphy (Business Radio Licence) (Amendment) Regulations. 1980 ( S.I. No. 193 of 1980 ).

4. Paragraph (1) of Regulation 9 of the Regulations of 1949, inserted by Regulation 4 of the Regulations of 1956 and amended by Regulation 4 of the Regulations of 1980, is hereby amended by--

( a ) the substitution of "eight pounds" for "seven pounds" in both places where it occurs in subparagraph (a);

( b ) the substitution of "eight pounds", "eight pounds" and "thirty pounds" for "seven pounds", "seven pounds" and "twenty-five pounds", respectively, in subparagraph (b);

( c ) the substitution of "forty pounds" and "eight pounds" for "thirty-two pounds" and "seven pounds", respectively, in subparagraph (c);

( d ) the substitution of "forty pounds", "eight pounds" and "thirty pounds" for "thirty-two pounds", "seven pounds" and "twenty-five pounds", respectively, in subparagraph (d);

and the said paragraph (1), as so amended, is set out in the Table to this Regulation.

TABLE

(1) A fee shall be payable on the issue and on each renewal of a business radio licence and such fee shall be calculated on the following basis:--

( a ) system comprising base and mobile stations only or system comprising mobile stations only: a fixed sum of eight pounds plus eight pounds for each station,

( b ) system comprising base, repeater and mobile stations or mobile and repeater stations: a fixed sum of eight pounds plus eight pounds for each base station and each mobile station plus thirty pounds in respect of each repeater station,

( c ) system comprising two fixed stations only, that is to say, a fixed point-to-point system: a fixed sum of forty pounds plus eight pounds for each station,

( d ) system comprising two fixed stations with repeater stations, that is to say, a fixed point-to-point system with repeater stations: a fixed sum of forty pounds plus eight pounds for each fixed station plus thirty pounds in respect of each repeater station.

5. Regulation 7 of the Regulations of 1957, as amended by Regulation 5 of the Regulations of 1980, is hereby amended by--

( a ) the substitution of "five pounds" for "four pounds" in both places where it occurs in paragraph (a);

( b ) the substitution of "five pounds" for "four pounds" in both places where it occurs and of "twenty pounds" for "fifteen pounds" in paragraph (b);

( c ) the substitution of "twenty-five pounds" and "five pounds" for "nineteen pounds" and "four pounds", respectively, in paragraph (c); and

( d ) the substitution of "twenty-five pounds", "five pounds" and "twenty pounds" for "nineteen pounds", "four pounds" and "fifteen pounds", respectively, in paragraph (d);

and the said Regulation 7, as so amended, is set out in the Table to this Regulation.

7. A fee shall be payable on the issue and renewal of a licence and such fee shall be calculated on the following basis:

( a ) system comprising base and mobile stations only or system comprising mobile stations only: a fixed sum of five pounds plus five pounds for each station,

( b ) system comprising base, repeater and mobile stations or mobile and repeater stations: a fixed sum of five pounds plus five pounds for each base station and each mobile station plus twenty pounds in respect of each repeater station,

( c ) system comprising two fixed stations only, that is to say, a fixed point-to-point system: a fixed sum of twenty-five pounds plus five pounds for each station,

( d ) system comprising two fixed stations with repeater stations, that is to say, a fixed point-to-point system with repeater stations: a fixed sum of twenty-five pounds plus five pounds for each fixed station plus twenty pounds in respect of each repeater station.

EXPLANATORY NOTE.

The purpose of these Regulations is to provide for an increase in the fees payable under the Wireless Telegraphy (Business Radio License) Regulations, 1949 to 1980 as follows:

''Annual' Business Radio Licenses

( a ) System comprising base and mobile stations only;

(i) Fixed Sum, from £7 to £8;

(ii) For each Station, from £7 to £8.

( b ) System comprising base, repeater and mobile stations or mobiles and repeater stations;

(i) Fixed Sum, from £7 to £8;

(ii) For each base and mobile station, from £7 to £8;

(iii) For each repeater station, from £25 to £30.

( c ) System comprising two fixed stations only ;

(i) Fixed Sum, from £32 to £40;

(ii) For each station, from £7 to £8.

( d ) System comprising two fixed stations with repeater stations;

(i) Fixed Sum, from £32 to £40;

(ii) For each fixed station, from £7 to £8;

(iii) For each repeater station, from £25 to £30.

Temporary Business Radio Licenses

( a ) System comprising base and mobiles stations only;

(i) Fixed Sum, from £4 to £5;

(ii) For each station, from £4 to £5.

( b ) System comprising base, repeater and mobile stations or mobile and repeater stations;

(i) Fixed Sum, from £4 to £5;

(ii) For each base and mobile station, from £4 to £5;

(iii) For each repeater station, from £15 to £20.

( c ) Systems comprising two fixed stations only;

(i) Fixed Sum, from £19 to £25;

(ii) For each station, from £4 to £5.

( d ) System comprising two fixed stations with repeater stations;

(i) Fixed Sum, from £19 to £25;

(ii) For each fixed station, from £4 to £5;

(iii) For each repeater station, from £15 to £20.
