S.I. No. 171/1984:

SOCIAL WELFARE (RENT ALLOWANCE) (AMENDMENT) REGULATIONS, 1984.

SOCIAL WELFARE (RENT ALLOWANCE) (AMENDMENT) REGULATIONS, 1984.

The Minister for Social Welfare, in exercise of the powers conferred on him by section 23 of the Housing (Private Rented Dwellings) Act, 1982 (No. 6 of 1982) and subsections (2) and (3) of section 3 of the Social Welfare (Consolidation) Act, 1981 (No. 1 of 1981), hereby makes the following Regulations:--

1. (1) These Regulations may be cited as the Social Welfare (Rent Allowance) (Amendment) Regulations, 1984.

(2) These Regulations and the Social Welfare (Rent Allowance) Regulations, 1982 to 1983, may be cited together as the Social Welfare (Rent Allowance) Regulations, 1982 to 1984.

2. These Regulations shall come into operation on the 4th day of July, 1984.

3. In these Regulations--

"the Principal Regulations" means the Social Welfare (Rent Allowance) Regulations, 1982 ( S.I. No. 220 of 1982 );

"the Regulations of 1983" means the Social Welfare (Rent Allowance) Regulations, 1983 ( S.I. No. 186 of 1983 ).

4. The Principal Regulations are hereby amended by the substitution in article 5 (2) of "£3.50" for "£3" in each case in which the said sum appears.

5. The Principal Regulations (as amended by the Regulations of 1983) are hereby further amended by--

(a) the substitution in article 5 (2) of "£84" for "£79" and "£48" for "£45";

(b) the substitution in article 5 (3) (a) of "£84" for "£79" and "£94" for "£89" in each case in which the said sum appears:

(c) the substitution in article 5 (3) (b) of "£48" for "£45" and "£53" for "£50" in each case in which the said sum appears;

(d) the substitution in article 6 (5) of "£7.70" for "£7.20", "£8.75" for "£8.20", "£6.85" for "£6.40" and "£5.45" for "£5.10".

6. Article 6 (1) of the Principal Regulations is hereby amended--

(a) by the substitution for sub-article (a) (iv) of the following sub-article:

"(iv) any sums arising from the investment or profitable use of property (not being property personally used or enjoyed by such person or a farm of land leased by him under a lease which has been certified by the Irish Land Commission to be bona fide and in accordance with sound land use practice);"

(b) by the substitution for substitution for sub-article (b) of the following sub-article:

"(b) the value of any property belonging to such person (not being property personally used or enjoyed by him or a farm of land leased by him under a lease which has been certified by the Irish Land Commission to be bona fide and in accordance with sound land use practice) which is invested or is otherwise put to profitable use or which, though capable of investment or profitable use, is not invested or put to profitable use, the yearly value of the first £400 of the property being taken to be one-twentieth part of the capital value and the yearly value of so much of the capital value of the property as exceeds the sum of £400 being taken to be one-tenth part of the capital value;"

(c) by the substitution for sub-article (c) of the following sub-article:

"(c) the yearly value of any advantage accruing to such person from--

(i) the use or enjoyment of property (other than a domestic dwelling or a farm building owned and occupied, or furniture and personal effects) which is personally used or enjoyed by him, and

(ii) the leasing by him of a farm of land under a lease which has been certified by the Irish Land Commission to be bona fide and in accordance with sound land used practice;".

7. Article 6 (1) of the Principle Regulations is hereby amended by the insertion after sub-article (iv) of the following sub-article:

"(v) any sums received by way of family income supplement under PART IVA of the Social Welfare (Consolidation) Act, 1981 (No. 1 of 1981) inserted by section 13 of the Social Welfare Act, 1984 (No. 5 of 1984)".

EXPLANATORY NOTE.

These Regulations amend the conditions for receipt of a rent allowance relating to the means text and calculation of the amount of an allowance consequent on provisions in the Social Welfare Act, 1984 (No. 5 of 1984) for an amendment in the method of calculation of means for other social welfare payments, and for general increases in payments from the beginning of July 1984.
