HARBOUR RATES (ARKLOW HARBOUR) ORDER, 1984.

HARBOUR RATES (ARKLOW HARBOUR) ORDER, 1984.

I, JIM MITCHELL, Minister for Communications, in exercise of the powers conferred on my by section 104 of the Harbours Act, 1946 (No. 9 of 1946), the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983), and after due compliance with section 106 of the Harbours Act, 1946 hereby order as follows:--

1. (1) This Order may be cited as the Harbour Rates (Arklow Harbour) Order, 1984.

(2) This Order shall come into operation on the 27th day of July, 1984.

2. (1) The rates set out in the Schedules to this Order are hereby fixed as the maximum rates to be charged by the Arklow Harbour Commissioners in respect of Arklow Harbour.

(2) Where rates fixed under this Order are payable at a metric tonne charge, lesser weights shall be chargeable as follows:--

(a) any weight not exceeding 250 kilogrammes shall count as 250 kilogrammes,

(b) any weight exceeding 250 kilogrammes but not exceeding 500 kilogrammes shall count as 500 kilogrammes,

(c) any weight exceeding 500 kilogrammes but not exceeding 750 kilogrammes shall count as 750 kilogrammes,

(d) any weight exceeding 750 kilogrammes but not exceeding 1 tonne shall count as 1 tonne.

3. The Harbour Rates (Arklow Harbour) Order, 1982 ( S.I. No. 384 of 1982 ), is hereby revoked.

SECOND SCHEDULE

Maximum Tonnage Rates.

On every ton of the net register tonnage or of half the gross tonnage, whichevery is the greater, of every vessel discharging or loading in the Harbour or the New Dock for each and every voyage.

On every ton of the net register tonnage or of half the gross tonnage, whichever is the greater, of every vessel (other than fishing boats or pleasure craft) sheltering or repairing in the Harbour or in the New Dock.

13p per week or part thereof.

3.

Rates on fishing vessels (net register tonnage)

(a) if under 5 tons

£2.80 for each entry into the harbour or £8.40 for the year payable in advance.

(b) if 5 tons or over but under 15 tons

£4.20 for each entry into the harbour or £16.80 for the year payable in advance.

(c) if 15 tons or over but under 50 tons

£5.60 for each entry into the harbour or £25.20 for the year payable in advance.

(d) if 50 tons or over but under 70 tons

£7.00 for each entry into the harbour or £33.60 for the year payable in advance.

(e) if 70 tons or over

£8.40 for each entry into the harbour or £41.40 for the year payable in advance.
4. Rates on pleasure vessels (net register tonnage) (except those paying the rates specified in para. (ii) below)

(i) (a) if under 2 tons

£4.20 for each entry into the harbour.

(b) if 2 tons or over but under 5 tons

£5.60 for each entry into the harbour.

(c) if 5 tons or over but under 10 tons

£8.40 for each entry into the harbour.

(d) if 10 tons or over but under 15 tons.

£11.20 for each entry into the harbour.

(e) if 15 tons or over.

£14.00 for each entry into the harbour.
The above charges would obtain for a stay not exceeding 7 days. An additional amount equal to 50% of the above charges would be payable per day thereafter.

(ii) On all pleasure vessels using the harbour as a composition in full of tonnage rates payable yearly in advance on 1st January or on entry to the harbour

(a) if under 2 tons

£25.20

(b) if 2 tons or over but under 5 tons

£33.60

(c) if 5 tons or over but under 10 tons

£50.40

(d) if 10 tons or over but under 15 tons

£67.20

(e) if 15 tons or over

£84.00

Rates on pleasure vessels (net register tonnage) laying up in Arklow Dock during the period 1st November in any year to 30th April in the following year

(a) if under 2 tons

£42.00

(b) if 2 tons or over but under 10 tons

EXPLANATORY NOTE.

This Order authorises Arklow Harbour Commissioners to charge revised goods, tonnage and other rates at Arklow Harbour.
