COUNTY MANAGEMENT (RESERVED FUNCTIONS) ORDER, 1985.

COUNTY MANAGEMENT (RESERVED FUNCTIONS) ORDER, 1985.

The Minister for the Environment in exercise of the powers conferred on him by subsection (3) of section 16 of the County Management Act, 1940 (No. 12 of 1940), hereby directs and orders as follows:--

1. This Order may be cited as the County Management (Reserved Functions) Order, 1985.

2. This Order shall come into effect on the 1st day of January, 1986.

3. The power of every council of a county and of every elective body to make charges for services provided in respect of domestic premises by virtue of section 2 of the Local Government (Financial Provisions) (No. 2) Act, 1983 (No. 21 of 1983) shall be exercisable and performable directly by such council or body.

4. The power of every county council and of every elective body to make charges for water supplied for domestic purposes by virtue of section 65A of the Public Health (Ireland) Act, 1878, inserted by section 7 of the Local Government (Sanitary Services) Act, 1962 (No. 26 of 1962), as amended by section 8 of the Local Government (Financial Provisions) (No. 2) Act, 1983 (No. 21 of 1983) shall be exercisable and performable directly by such council or body.

5. In this order "domestic premises" means a premises used wholly or mainly as a dwelling.

EXPLANATORY NOTE

This Order transfers the power to make charges for services provided in respect of domestic premises situated in non-county boroughs, urban districts and counties from the manager to the elected members (of the relevant local authority).
