AQUACULTURE (KILLARY HARBOUR) ORDER, 1986.

I, PADDY O'TOOLE, Minister for Tourism, Fisheries and Forestry, in exercise of the powers conferred on me by section 54 of the Fisheries Act, 1980 (No. 1 of 1980), as amended by section 5 of the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983), and by the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 ) (as adapted by the Fisheries and Forestry (Alteration of Name of Department and Title of Minister) Order, 1978 ( S.I. No. 195 of 1978 )), having complied with the requirements of subsection (3) of the said section 54, and having considered a report made to me under subsection (4) of the said section 54, and being of the opinion that, notwithstanding the existence of any public right to fish in the waters to which the following order relates, it is in the public interest that the order be made, hereby, with the consent of the Minister for Communications, order as follows:

1. This Order may be cited as the Aquaculture (Killary Harbour) Order, 1986.

2. The area described in the Schedule hereto is hereby designated to be an area within which it shall be lawful to engage in aquaculture pursuant to and in accordance with a licence granted under section 54 of the Fisheries Act, 1980 (No. 1 of 1980).

SCHEDULE

All that area of Killary Harbour and the waters adjoining thereto, which is bordered by the high water mark of that Harbour and those waters, and lies to the east of a straight line drawn in a due south direction from the most westerly point of the high water mark of the townland of Doovilra, barony of Murrisk and County of Mayo, to the point where such line meets the high water mark of the townland of Glassillaun, barony of Ballynahinch and County of Galway.

EXPLANATORY NOTE.

This Order designates the area of Killary Harbour, Co. Galway within which it shall be lawful to engage in aquaculture pursuant to a licence issued by the Minister for Tourism, Fisheries and Forestry.
