DISTRICT COURT AREAS (AMENDMENT) (VARIATION OF DAYS AND HOURS) ORDER, 1986

DISTRICT COURT AREAS (AMENDMENT) (VARIATION OF DAYS AND HOURS) ORDER, 1986

I, ALAN M. DUKES, Minister for Justice, in exercise of the powers confered on me by section 26 (1) of the Courts of Justice Act, 1953 (No. 32 of 1953), and after consultation with the President of the District Court, hereby order as follows:

1. (1) This Order may be cited as the District Court Areas (Amendment) (Variation of Days and Hours) Order, 1986.

(2) This Order shall come into operation on the 1st day of November, 1986.

2. In this Order "the Principal Order" means the District Court (Areas) Order, 1961 ( S.I. No. 5 of 1961 ).

3. The Principal Order (as amended by the District Court Areas (Variation of Days and Hours) (No 4) Order, 1977 ( S.I. No. 375 of 1977 )), is hereby amended by the deletion of the matter at reference number 254 in columns (1), (2), (3), (4) and (5), respectively, in the First Schedule thereto.

4. The district court area of New Ross is hereby varied by the addition to the District Electoral Divisions in the county of Wexford mentioned in column (5) at reference number 258 in the First Schedule to the Principal Order of the District Electoral Divisions of Ballyhack, Bannow, Clongeen, Fethard, Killesk, Kilmokea, Rathroe, Templetown, Tintern and Whitechurch (New Ross).

5. The district court area of Wexford is hereby varied by the addition to the District Electoral Divisions mentioned in column (5) at reference number 259 in the First Schedule to the Principal Order of the District Electoral Divisions of Ballymitty and Harristown.

6. The days and hours for holding the District Court in the district court area of Wexford shall, in lieu of the days and hours specified in column (4) at reference number 259 in the First Schedule to the Principal Order, be the first and third Wednesday in each month at 11 a.m. and the third Thursday in January, March, May, July, September and November at 11 a.m.

7. The First Schedule to the District Court (Districts) Order, 1961 ( S.I. No. 6 of 1961 ), is hereby amended by the deletion in column (3) at reference number 23 of "Ballycullane".

8. The Schedule to the District Court Areas (Amendment) Order, 1970 ( S.I. No. 161 of 1970 ), is hereby amended by the deletion in column (4) at reference number 23 of "Ballycullane" and "254".

9. Business transacted in the District Court which is initiated and is not completed before the commencement of this Order shall be continued and completed as if this Order had been in force at the time at which such business was initiated.

EXPLANATORY NOTE.

This Order provides for the abolition of the District Court Area of Ballycullane and the amalgamation of the District Electoral Divisions which comprised it, in part with the District Court Area of New Ross and in part with the District Court Area of Wexford. The Order also provides for additional sitting days for sittings of the District Court in Wexford.
