S.I. No. 13/1988:

BEAUMONT HOSPITAL BOARD (ESTABLISHMENT) ORDER, 1977 (AMENDMENT) ORDER, 1988.

BEAUMONT HOSPITAL BOARD (ESTABLISHMENT) ORDER, 1977 (AMENDMENT) ORDER, 1988.

The Minister for Health in exercise of the powers conferred on him by sections 3,4 and 5 of the Health (Corporate Bodies) Act, 1961 (No. 27 of 1961) hereby orders as follows:--

1. This Order may be cited as the Beaumont Hospital Board (Establishment) Order, 1977 (Amendment) Order. 1988.

2. The Beaumont Hospital Board (Establishment) Order, 1977 ( S.I. No. 255 of 1977 ) is hereby amended:--

(a) by the substitution for article 4 of the following article:--

"4. The functions of the Board are as follows:--

(a) to conduct, maintain, manage and develop at the hospital built by the Board at Beaumont, Dublin, such hospital services as may, from time to time, be approved by the Minister;

(b) to provide such facilities for the teaching of medical, nursing and para-medical students as may, from time to time, be determined by the Minister after consultation with the Board;

(c) to provide such other services and facilities as may, from time to time, be determined by the Minister, after consultation with the Board."

(b) by the substitution with effect from the 27th day of January 1988 for article 5 of the following article:--

"5. On the 27th day of January 1988 the term of office of each member of the Board appointed before that date shall terminate and on and after that date the Board shall consist of not more than twelve members appointed by the Minister."

(c) by the substitution for article 6 of the following article:--

"6. The term of office of a member of the Board shall be such period not exceeding three years as may be specified by the Minister when appointing him and he shall hold office for the period for which he is appointed unless he sooner dies, resigns or ceases to be a member in accordance with article 8 of this Order."

(d) by the substitution for article 7 of the following article:--

"7. In the event of a casual vacancy arising through the death, resignation or cessation of membership under article 8 of this Order of a member of the Board, the vacancy shall be filled by appointment by the Minister and the person so appointed shall hold office as a member of the Board for the unexpired period of the term of office of the said member."

(e) by the substitution for article 8 of the following article:--

"8. A member shall cease to be a member of the Board on his being requested by the Minister to resign."

EXPLANATORY NOTE

The effect of this Order is to redefine the functions of and amend the method of appointment to the Beaumont Hospital Board, to take account of the fact that the hospital has now been opened and is fully operational.
