S.I. No. 186/1989:

SOCIAL WELFARE (PRESERVATION OF RIGHTS) (AMENDMENT) (No. 2) REGULATIONS, 1989.

SOCIAL WELFARE (PRESERVATION OF RIGHTS) (AMENDMENT) (No. 2) REGULATIONS, 1989.

The Minister for Social Welfare, in exercise of the powers conferred on him by section 3 of the Social Welfare (Consolidation) Act, 1981 (No. 1 of 1981 ) and by section 20 of the Social Welfare (No. 2) Act, 1985 (No. 14 of 1985), hereby makes the following Regulations:--

1. These Regulations may be cited as the Social Welfare (Preservation of Rights) (Amendment) (No. 2) Regulations, 1989.

2. In these Regulations--

"the Principal Regulations" means the Social Welfare (Preservation of Rights) (No. 2) Regulations, 1986 ( S.I. No. 422 of 1986 );

"the Regulations of 1988" means the Social Welfare (Preservation of Rights) (Amendment) Regulations, 1988 ( S.I. No. 63 of 1988 ).

3. The Principal Regulations are hereby amended by--

( a ) the substitution for the definition of relevant date of adjustment contained in article 3 of the following:--

"'relevant date of adjustment' means--

( a ) the 19th day of July, 1989 in the case of unemployment assistance,

( b ) the 20th day of July, 1989 in the case of unemployment benefit,

( c ) the 24th day of July, 1989 in the case of disability benefit, maternity allowance, injury benefit and disablement benefit,

( d ) the 27th day of July, 1989 in the case of retirement pension and invalidity pension,

( e ) the 28th day of July, 1989 in the case of old age (contributory) pension.",

( b ) the substitution in sub-article (a) of article 6A (as inserted by article 4 of the Regulations of 1988) of "the sum of £16" for "the sum of £18",

( c ) the substitution in sub-article (b) (i) of article 6A (as inserted by article 4 of the Regulations of 1988) of "£8," for "£9,", and

( d ) the substitution for article 7 (1A) (as inserted by article 5 (b) of the Regulations of 1988) of the following sub-article:--

"(1A) An increase in a payment under article 6A of these Regulations shall be paid for the duration of the period of continuous entitlement to that payment or until:--

( a ) the 26th day of December, 1989 in the case of unemployment assistance,

( b ) the 27th day of December, 1989 in the case of unemployment benefit,

( c ) the 31st day of December, 1989 in the case of disability benefit, maternity allowance, injury benefit and disablement benefit,

( d ) the 3rd day of January, 1990 in the case of retirement pension and invalidity pension,

( e ) the 4th day of January, 1990 in the case of old age (contributory) pension,

whichever is the shorter.".

EXPLANATORY NOTE.

These Regulations provide that the transitional payment being made to persons whose social welfare payment were reduced as a consequence of the revised dependency arrangements introduced under the Social Welfare (No. 2) Act, 1985 will continue to be made up to the end of 1989.

The Regulations also provide that the transitional payments of £18 and £9 will be reduced to £16 and £8 respectively with effect from the last week in July, 1989.
