I, JOHN P. WILSON, Minister for the Marine, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 91 of 1987 ), and after due compliance with section 106 of the said Harbours Act, 1946 , hereby order as follows:--

1. (1) This Order may be cited as the Harbour Rates (Galway Harbour) Order, 1989.
|
|
|
(2) This Order shall come into operation on the 1st day of January 1990.
|
|
|
2. (1) The maximum rate to be charged by Galway Harbour Commissioners in respect of goods to be imported into or exported from the State or otherwise loaded or unloaded at Galway Harbour of a description specified in column (2) of the First Schedule to this Order at any reference number is hereby fixed as the rate specified in column (3) of the said Schedule at that reference number.

(2) The maximum tonnage rate to be charged by Galway Harbour Commissioners in respect of the use of Galway Harbour by a vessel in the circumstances specified in any paragraph in column (2) of the Second Schedule to this Order at reference number 1 or 2 or by a vessel of a description specified in any paragraph in the said column (2) at reference number 3 or 4 is hereby fixed as the rate specified opposite that paragraph in column (3) of the said Schedule at that reference number.

|
(3) Where rates fixed under this Order are chargeable by reference to metric tonnage, weights of less than 1 metric tonne shall be chargeable as follows:--
|
|
|
( a ) any weight not exceeding 250 kilogrammes shall be charged as 250 kilogrammes,
|
|
|
( b ) any weight exceeding 250 kilogrammes but not exceeding 500 kilogrammes shall be charged as 500 kilogrammes,
|
|
|
( c ) any weight exceeding 500 kilogrammes but not exceeding 750 kilogrammes shall be charged as 750 kilogrammes,
|
|
|
( d ) any weight exceeding 750 kilogrammes but not exceeding 1 metric tonne shall be charged as 1 metric tonne.
|
|
|
3. The Harbour Rates (Galway Harbour) Order, 1987 ( S.I. No. 329 of 1987 ), is hereby revoked.

(c) On every ton of the net register tonnage or of half the gross tonnage, whichever is the greater, or every vessel entering the harbour and not shipping, unshipping or transhipping any cargo or passengers, other than provisions or fuel to be used for the purpose of the voyage, if from or to a port or place mentioned at (a) above, a sum not exceeding--

2. |
Lying up charges: (payable in addition to charges at reference numbers 1 and 3 of this schedule):
|
|
|
(a) On every ton of the net register tonnage or half the gross tonnage, whichever is the greater, of every vessel lying alongside any pier or wharf or moored in the vicinity thereof or lying in any dock other than a graving dock, after the expiration of a period of fourteen days,
|
|
|
for each week or part of a week for the first four weeks a sum not exceeding--
|

|
for each subsequent week or part of a week a sum not exceeding--
|

(b) On every ton of the net register tonnage, or half the gross tonnage whichever is the greater, of every vessel not subject to the charge at 2 (a) lying in the harbour after the expiration of a period of fourteen days--

for each week or part of a week for the first four weeks a sum not exceeding--

for each subsequent week or part of a week a sum not exceeding--

For the purpose of these charges any vessel using the port will be deemed to have a minimum net tonnage of 500 tons.
|
|
3. |
Tonnage rates on fishing vessels:
|
|
|
On every mechanically propelled fishing vessel not exceeding 120 tons using the harbour, as a composition of tonnage rates payable each year on 1st January, an annual sum not exceeding--
|
|
|
(a) If 65 tons gross or over but under 120 tons gross;
|

(b) If 25 tons gross or over but under 65 tons gross;

(c) If under 25 tons gross;
|
£26.25 |
|
Fishing vessels in excess of 120 tons shall be liable for same tonnage rate as will apply to commercial vessels.

4. |
Tonnage rates on vessels other than those described at reference numbers 1 and 3 of this Schedule:
|
|
|
On every vessel in whatever way propelled including yachts, sailing boats, motor boats and rowing boats, and including such vessels plying for hire, using or lying alongside any dock, wharf, or pier at the harbour, an annual sum not exceeding--

EXPLANATORY NOTE.
|
|
|
