HARBOUR RATES (YOUGHAL HARBOUR) ORDER, 1990.

HARBOUR RATES (YOUGHAL HARBOUR) ORDER, 1990.

I, JOHN P. WILSON, Minister for the Marine, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 91 of 1987 ), and after due compliance with section 106 of the said Act, hereby order as follows:

1. This Order may be cited as the Harbour Rates (Youghal Harbour) Order, 1990.

2. This Order shall come into operation on the 1st day of June, 1990.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. The Youghal Harbour Order, 1878, shall have effect as if, for Parts I and II of the Schedule thereto (inserted by the Harbour Rates (Youghal Harbour) Order, 1943 ( S. R. & O. No. 346 of 1943 )), as amended by the Harbour Rates (Youghal Harbour) Order, 1983 ( S.I. No. 395 of 1983 ), there were substituted the following--

ACTUAL RATES

I. Rates on Vessels.

1. On every ship, vessel or steamer ( other than a yacht or other pleasure boat) entering the harbour to discharge or load cargo, on each occasion of entering the harbour, per net registered ton

0.40

2. On every ship, vessel or steamer ( other than a yacht or other pleasure boat) entering the harbour for the purpose of seeking refuge, per net registered ton

0.40

3. On every ship, vessel or steamer ( other than a yacht or other pleasure boat) entering the harbour unladen and using the docks or quays within the harbour for the purpose of repairs or cleaning, per net registered ton

0.40

4. On every yacht or other pleasure boat entering or using the harbour, per day

4.00

5. On every yacht or other pleasure boat entering the harbour, payable in advance, on the 1st day of June in each year as a composition in full for one year of all tonnage rates mentioned in this Part of this Schedule if the gross weight of the yacht or other pleasure boat--

(a) is less than one ton

10.00

(b) is one ton or more but less than five tons

20.00

(c) is five tons or more but less than twenty tons

30.00

(d) is more than twenty tons

40.00

II. Rates on goods, whether landed on, or shipped from, the quays, or loaded from, or unloaded into, lighters or barges.

1. Animal foodstuffs, per tonne

0.40

2. Coal, per tonne

0.40

3. Fertiliser, per tonne

0.40

4. Grain, per tonne

0.40

5. Goods not mentioned elsewhere in this Schedule, per tonne.

6. The Harbour Rates (Youghal Harbour) Order, 1983 ( S.I. No. 395 of 1983 ), is hereby revoked.

EXPLANATORY NOTE.

The effect of this Order authorises Youghal Urban District Council to charge increased actual goods and tonnage rates at Youghal Harbour.
