S.I. No. 141/1990:

PETROLEUM AND OTHER MINERALS DEVELOPMENT ACT, 1960 (SECTION 13A) REGULATIONS, 1990.

PETROLEUM AND OTHER MINERALS DEVELOPMENT ACT, 1960 (SECTION 13A) REGULATIONS, 1990.

The Minister for Energy, in exercise of the powers conferred on him by section 13A [as inserted by the European Communities (Environmental Impact Assessment) Regulations, 1989 ( S.I. No. 349 of 1989 )] and section 61 of the Petroleum and Other Minerals Development Act, 1960 (No. 7 of 1960) and the Energy (Transfer of Departmental Administration and Ministerial Functions) Order, 1980, ( S.I. No. 9 of 1980 ) as adapted by the Industry and Energy (Alteration of Name of Department and Title of Minister) Order, 1983 ( S.I. No. 385 of 1983 ), hereby makes the following Regulations:

1. These Regulations may be cited as the Petroleum and Other Minerals Development Act, 1960 (Section 13A) Regulations, 1990.

2. In these Regulations "the Act of 1960" means the Petroleum and Other Minerals Development Act, 1960 (No. 7 of 1960).

3. The prescribed period provided for by section 13A (2) (d ) of the Act of 1960 shall be:

( a ) in the case of prescribed bodies, one month from the date of issue of a copy of the environmental impact statement to that body, and

( b ) in the case of any interested person, one month from the date of publication in newspapers, pursuant to section 13A (2) of the Act of 1960, of a notice giving details of the application and the place where a copy of the environmental impact statement may be inspected or purchased.

4. The prescribed bodies pursuant to the provisions of section 13A (4) of the Act of 1960 shall be:

( a ) all local authorities contiguous to whose functional area it is proposed to extract petroleum;

( b ) the Commissioners of Public Works;

( c ) An Taisce.

EXPLANATORY NOTE.

These Regulations provide for the prescribing of the period for consideration of and submissions on Environmental Impact Statements relating to projects for the extraction of petroleum (including natural gas) as provided for under the European Communities (Environmental Impact Assessment) Regulations 1989, and lists the prescribed bodies to whom the Environmental Impact Statements must be provided for comment.
