I, JOHN P. WILSON, Minister for the Marine in exercise of the powers conferred on me by Section 19A (as inserted by the European Communities (Environmental Impact Assessment Regulations, 1989 ( S.I. No. 349 of 1989 )) of the Foreshore Act, 1933 (No. 12 of 1933) and the Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 91 of 1987 ) and the Tourism, Fisheries and Forestry (Alteration of Name of Department and Title of Minister) Order, 1987 ( S.I. No. 82 of 1987 ), hereby make the following Regulations:

Citation

1. These Regulations may be cited as the Foreshore (Environmental Impact Assessment) Regulations, 1990.

2. (i) In these Regulations "the Act of 1933" means "the Foreshore Act, 1933 " (No. 12 of 1933).

(ii) the Interpretation Act, 1937 (No. 38 of 1937) applies to these Regulations.

3. The prescribed period provided in Section 19A (1) (d) of the Act of 1933 shall be:

( a ) in the case of prescribed bodies, one month for consideration and response from the date of issue by the applicant of a copy of the environmental impact statement to that body, and

( b ) in the case of any interested person, one month from the date of publication in the newspapers by the applicant giving details of the application and the place where a copy of the environmental impact statement may be inspected or purchased.

4. The prescribed bodies provided in Section 19 (A) (3) of the Act of 1933 shall be:

( a ) the Commissioners of Public Works in Ireland if the development is to take place on an area of archaeological, scientific or ecological interest or both;

( b ) the Local Authority within whose functional area or contiguous to whose functional area the proposed development is to take place;

( c ) An Taisce, the National Trust for Ireland if the development is to take place on an area of apecial amenity value or special interest;

( d ) Bord Failte Eireann.

EXPLANATORY NOTE.

These Regulations provide, insofar as applications for leases and licences under Sections 2 and 3 of the Foreshore Act 1933 to carry out developments on the foreshore are concerned, for prescribed times for consideration of Environmental Impact Statements provided further to the European Communities (Environmental Impact Assessment) Regulations 1989 and lists prescribed bodies to whom the Environmental Impact Statements will be provided for comment.
