POISONS (AMENDMENT) REGULATIONS, 1991.

POISONS (AMENDMENT) REGULATIONS, 1991.

In exercise of the powers conferred on the Minister for Health by section 14 of the Poisons Act, 1961 (No. 12 of 1961) as amended by section 33 of the Misuse of Drugs Act, 1977 (No. 12 of 1977), which said powers are delegated to me by the Health (Delegation of Ministerial Functions) Order, 1991 ( S.I. No. 231 of 1991 ), I, CHRIS FLOOD, Minister of State at the Department of Health, hereby make the following Regulations:--

1. (1) These Regulations may be cited as the Poisons (Amendment) Regulations, 1991.

(2) These Regulations shall be construed as one with the Poisons Regulations, 1982 to 1986, and may be cited together with those Regulations as the Poisons Regulations, 1982 to 1991.

2. The Poisons Regulations, 1982 ( S.I. No. 188 of 1982 ) are hereby amended:--

( a ) by the deletion in article 2 of the definition inserted by article 3 (a) of the Poisons (Amendment) Regulations, 1986 ( S.I. No. 424 of 1986 );

( b ) by the substitution in article 4 of the following definition for "authorised person"--

"'authorised person' has the meaning assigned to it by section 2 of the Pharmacy Act, 1962 (No. 14 of 1962) as amended by section 34 of the Misuse of Drugs Act, 1977 (No. 12 of 1977) and by article 4 of the European Communities (Recognition of Qualifications in Pharmacy) Regulations, 1991 ( S.I. No. 330 of 1991 )."

( c ) by the insertion in article 4 after the definition of "local authority" of the following definition--

""mastitis control programme" means a programme having as its primary objective the prevention and treatment of bovine mastitis, conducted by a Co-Operative Society registered under the Industrial and Provident Societies Acts, 1893 to 1978, engaged in the processing of milk, which includes the collection and dissemination of data on the organisms prevalent in bovine mastitis and their current sensitivity patterns and which is operated under the direction and control of an authorised person, registered druggist or registered veterinary surgeon.";

( d ) by the substitution of the following article for article 16--

"16. Strychnine, its salts or quaternary compounds or preparations thereof containing 0.2% or more of strychnine shall not be sold or supplied or offered for sale or supply except--

( a ) to a Department of State, local authority or health board for the purpose of destruction, or

( b ) to a person or institution concerned with scientific research, education or analysis for the purpose of such research, education or analysis.";

( e ) by the insertion of the following sub-article after sub-article (4) in article 17--

"(4A) Preparations containing chlordane, chlordecone or reserpine, or any of their isomeric compounds, shall not be sold or supplied, or offered for sale or supply, for use as a pesticide.";

( f ) by the insertion in Part I of the First Schedule--

(i) after the words "Organochlorine compounds, the following; their isomers:-- Aldrin, "of the words "Chlordane, Chlordecone,"

(ii) after the word "Razoxane" of the word "Reserpine";

( g ) by the deletion of the Fourteenth Schedule.

EXPLANATORY NOTE.

These Regulations amend the Poisons Regulations, 1982 to 1986. They prohibit the sale or supply or the offering for sale or supply of chlordane, chlordecone, reserpine and strychnine. In the case of strychnine an exemption is provided in respect of the sale or supply to a Department of State etc. for the purpose of destruction.
