HOUSING (TRANSFER OF FUNCTIONS) ORDER, 1993. |

In exercise of the powers conferred on the Minister for the Environment by section 23 (3) of the Housing (Miscellaneous Provisions) Act, 1992 (No. 18 of 1992), which powers are delegated to me by the Environment (Delegation of Ministerial Functions) (No. 2) Order, 1993 ( S.I. No. 128 of 1993 ), I, EMMET STAGG, Minister of State at the Department of the Environment, hereby order as follows:-- |

1. This order may be cited as the Housing (Transfer of Functions) Order, 1993. |
||
2. The functions of the council of the county of Louth as respects sections 2 to 4 and sections 6 and 7 of the Housing (Miscellaneous Provisions) Act, 1992 , are hereby transferred-- |
||
( a ) in the case of the borough of Drogheda, to the Mayor, Aldermen and Burgesses of Drogheda, and |
||
(b) in the case of the urban district of Dundalk, to the council of the said urban district. |
||
3. The Mayor, Aldermen and Burgesses of Drogheda and the council of the urban district of Dundalk shall, as respects the said borough and said urban district respectively, perform the functions hereby transferred separately from the functional area of the council of the county of Louth. |

4. (1) Expenses in relation to the functions hereby transferred shall-- |
||
( a ) as respects the performance of the functions by the Mayor, Aldermen and Burgesses of Drogheda, be defrayed out of the municipal fund of the borough of Drogheda, and |
||
( b ) as respects the performance of the functions by the council of the urban district of Dundalk, be defrayed out of the municipal fund of that urban district. |
||
(2) In this article "municipal fund" has the meaning assigned to it by the Local Government Act, 1946 (No. 24 of 1946). |
||

EXPLANATORY NOTE. |
||
This order transfers to Drogheda Corporation and Dundalk Urban District Council, as respects to their functional areas, certain functions performed by Louth County Council in relation to shared ownership leases and the granting of assistance to approved housing bodies. |
