HARBOUR RATES (LIMERICK HARBOUR) ORDER, 1996.

I, SEÁN BARRETT, Minister for the Marine, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 91 of 1987 ), and after due compliance with section 106 of the said Harbours Act, 1946 , hereby order as follows:

1. (1) This Order may be cited as the Harbour Rates (Limerick Harbour) Order, 1996.

(2) This Order shall come into operation on the 1st day of July, 1996.

2. In this Order "the Order of 1996" means the Harbour Rates (Limerick Harbour) Order, 1996 ( S.I. No. 113 of 1996 ).

3. The Harbour Rates (Limerick Harbour) Order, 1942 (S.R. & O., No. 469 of 1942), is hereby amended by:

(a) the substitution for paragraph (3) of Article 5 of the following paragraph:

"(3) where rates payable under this Article are fixed at a tonnage charge, lesser weights shall be chargeable as follows:

(a) any weight under 500 kilos shall count as 500 kilos;

(b) any weight over 500 kilos and under a tonne shall count as a tonne."

(b) the substitution for the First Schedule (inserted by the Order of 1996) thereto of the following Schedule:

PART II

Provisions applicable to rates mentioned in Part I (a) of this Schedule.

1. The tonnage rates (other than those specified at reference number 5) shall not be chargeable on vessels trading in or upon the River Shannon.

2. For the purpose of calculating tonnage rates, the tonnage of vessels shall be taken to be the Gross Tonnage (GT) as laid down in the International Tonnage Convention, 1969.

Provisions applicable to rates mentioned in Part I (b) of this Schedule.

1. The tonnage rates (other than those specified at reference number 5) shall not be chargeable on vessels trading in or upon the River Shannon.

2. For the purpose of calculating tonnage rates, (other than those specified in reference number 5), the tonnage of vessels shall be taken to be the Net Registered Tonnage or half the Gross Registered Tonnage thereof whichever is the greatest."

EXPLANATORY NOTE.

This Order authorises the Limerick Harbour Commissioners to charge revised goods, tonnage and other rates at Limerick Harbour.
