S.I. No. 206/1996:

HERITAGE ACT, 1995 (DESIGNATION OF HERITAGE BUILDING) ORDER, 1996.

HERITAGE ACT, 1995 (DESIGNATION OF HERITAGE BUILDING) ORDER, 1996.

I, MICHAEL D. HIGGINS, T.D., Minister for Arts, Culture and the Gaeltacht, on the advice of The Heritage Council and after consultation with the South-Eastern Health Board, hereby, in exercise of the powers conferred on me by section 10 of the Heritage Act, 1995 (No. 4 of 1995), order as follows:

1. This Order may be cited as the Heritage Act, 1995 (Designation of Heritage Building) Order, 1996.

2. In this Order --

"the deposited map" means the map that was deposited in the Department of Arts, Culture and the Gaeltacht, Dublin, on the 25th day of June, 1996, sealed with the Official Seal of the Minister and signed by the Minister and has at the top thereof the words and figures "Deposited for the purposes of the Heritage Act, 1995 (Designation of Heritage Building) Order, 1996";

"the Minister" means the Minister for Arts, Culture and the Gaeltacht.

3. Each of the buildings known as the Old County Hospital situated in the townland of Carricklawn arid county of Wexford (being the buildings coloured red on the deposited map) and owned by the South-Eastern Health Board is hereby designated as a heritage building to which section 10 of the Heritage Act, 1995 (No. 4 of 1995), applies.

EXPLANATORY NOTE

Under this Order, made under section 10 of the Heritage Act, 1995 , the Minister for Arts, Culture and the Gaeltacht has, on the advice of the Heritage Council and after consultation with the responsible public authority (viz. the South-Eastern Health Board), designated the Old County Hospital, Wexford, owned by the South-Eastern Health Board, as a heritage building.

Section 10 of the Heritage Act, 1995 , also provides that

-- the Heritage Council may consult with or advise a public authority in relation to the maintenance, preservation, restoration, upkeep and improvement of a designated heritage building owned by the authority;

-- a public authority must notify the Heritage Council of any proposal to demolish, alter significantly or dispose of a designated heritage building vested in the authority, or any land or other building adjoining such a building; the Council must tender its advice to the public authority in relation to such a proposal; and the public authority may not proceed with such a proposal contrary to the advice of the Council unless the Minister for Arts, Culture and the Gaeltacht agrees to the proposal, or to a modified form of the proposal, or the Government agrees to the proposal.
