I, John O'Donoghue, Minister for Justice, Equality and Law Reform, in exercise of the powers conferred on me by section 6 (7) of the Criminal Justice (Miscellaneous Provisions) Act, 1997 (No. 4 of 1997), and the Justice (Alteration of Name of Department and Title of Minister) Order, 1997 ( S.I. No. 298 of 1997 ), hereby make the following Regulations:

1. (1) These Regulations may be cited as the Criminal Justice (Miscellaneous Provisions) Act, 1997 (Section 6) Regulations, 1997.
|
|
|
(2) These Regulations shall come into operation on the 8th day of September 1997.
|
|
|
2. In these Regulations
|
|
|
"section 6" means section 6 of the Criminal Justice (Miscellaneous Provisions) Act, 1997 (No. 4 of 1997):
|
|
|
"member" means a member of the Garda Síochána.
|
|
|
3. (1) A certificate under subsection (1) of section 6 relating to the arrest and cautioning of a person for a specified offence shall be in the form set out in the First Schedule to these Regulations.
|
|
|
(2) A certificate under subsection (1) of section 6 relating to the charging and cautioning of a person for a specified offence shall be in the form set out in the Second Schedule to these Regulations.
|
|
|
(3) A certificate under subparagraph (i) of paragraph (a) of subsection (2) of section 6 shall be in the form set out in the Third Schedule to these Regulations.
|
|
|
(4) A certificate under subparagraph (ii) of paragraph (a) of subsection (2) of section 6 shall be in the form set out in the Fourth Schedule to these Regulations.
|
|
|
(5) A certificate under paragraph (b) of subsection (2) of section 6 shall be in the form set out in the Fifth Schedule to these Regulations.

EXPLANATORY NOTE
|
|
|
These regulations prescribe the form of certificates under section 6 of the Criminal Justice (Miscellaneous Provisions) Act, 1997 .
