I, Tom Kitt, Minister of State at the Department of Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 28 of the Safety, Health and Welfare at Work Act, 1989 (No. 7 of 1989) and the Labour (Transfer of Departmental Administration and Ministerial Functions) Order, 1993 ( S.I. No. 18 of 1993 ), as adapted by the Enterprise and Employment (Alteration of Name of Department and Title of Minister) Order, 1997 ( S.I. No. 305 of 1997 ), and the Enterprise, Trade and Employment (Delegation of Ministerial Functions) (No. 2) Order, 1997 ( S.I. No. 330 of 1997 ), and after consultation with the National Authority for Occupational Safety and Health, and for the purpose of giving effect to Council
Directives 90/679/EEC of 26 November 19901 as amended by Council Directive 93/88/EEC of 12 October 19932, Commission Directive 95/30/EC of 30 June 19953, Commission Directive 97/59/EC of 7 October 19974 and Commission Directive 97/65/EC of 26 November 19975, hereby make the following regulations:--

1. These Regulations may be cited as the Safety, Health and Welfare at Work (Biological Agents) (Amendment) Regulations, 1998.
|
|
|
2. The Safety, Health and Welfare at Work (Biological Agents) Regulations, 1994 ( S.I. No. 146 of 1994 ), are hereby amended by the substitution for the Fourth Schedule thereto of the Schedule to these Regulations.

1. Certain biological agents classified in Group 3 which are indicated in the appended list by an asterisk (*), may present a limited risk of infection for workers because they are not normally infectious by the air-borne route.
|
|
|
2. This list also gives a separate indication in cases where the biological agents are likely to cause allergic or toxic reactions, where an effective vaccine is available, or where it is advisable to keep a list of exposed workers for more than 10 years.
|
|
|
These indications are shown by the following letters:
|
|
|

|

D: List of workers exposed to this biological agent to be kept for more than 10 years after the end of last known exposure
|
|

(b) Hepatitis D virus is pathogenic in workers only in the presence of simultaneous or secondary infection caused by hepatitis B virus.

Vaccination against hepatitis B virus will therefore protect workers who are not affected by hepatitis B virus against hepatitis D virus (Delta).
|
|
|
(c) Only for types A and B.
|
|
|
(d) Recommended for work involving direct contact with these agents.
|
|
|
(e) Two viruses are identified: one a buffalopox type and the other a variant of the Vaccinia virus.
|
|
|

(h) At present there is no evidence of disease in humans caused by the other retroviruses of simian origin. As a precaution containment level 3 is recommended for work with them.
|
|
|
(i) There is no evidence in humans of infections caused by the agents responsible for other animal TSEs. Nevertheless, the containment measures for agents categorised in risk group 3 (*) are recommended as a precaution for laboratory work, except for laboratory work relating to an identified agent of scrapie where containment level 2 is sufficient.

EXPLANATORY NOTE
|
|
|
These Regulations implement Commission Directive 95/30/EC of 30th June, 1995, Commission Directive 97/59/EC of 7th October, 1997, and Commission Directive 97/65/EC of 26th November 1997 on the protection of workers from risks related to exposure to a biological agent at work, which amended the list of biological agents contained in Council Directive 93/88/EEC. These Regulations replace the list of Biological Agents contained in the Fourth Schedule of the Safety, Health and Welfare at Work (Biological Agents) Regulations, 1994 which implemented Council Directives 90/679/EEC and 93/88/EEC on the protection of workers from risks related to exposure to biological agents at work, with the list contained in the Schedule of these Regulations. In the list, biological agents are classified as Group 2, Group 3 and Group 4 agents. This classification is in ascending order of severity. Risk assessment and the provision of vaccination as provided for
in Regulations 4 and 6 of the Safety, Health and Welfare at Work (Biological Agents) Regulations, 1994, respectively, must be carried out with reference to the list of biological agents in accordance with Regulations 4(e)(i) and 6(2)(b) of those Regulations.
