AIR NAVIGATION (PERSONNEL LICENSING) (No. 2) (AMENDMENT) ORDER, 1999. |

THE IRISH AVIATION AUTHORITY, in exercise of the powers conferred on it by sections 5, 6, 58, 59 and 60 of the Irish Aviation Authority Act, 1993 (No. 29 of 1993) as adapted by section 75 and as amended by the Air Navigation and Transport Act, 1998, No. 24 of 1998 , hereby orders as follows:-- |

1. (1) This Order may be cited as the Air Navigation (Personnel Licensing) No. 2 (Amendment) Order, 1999. |
||||||||||||
(2) The Air Navigation (Personnel Licensing) Orders, 1966 to 1999 and this Order may be cited together as one. |
||||||||||||
(3) This Order shall come into operation on the 1st day of June, 1999. |
||||||||||||
2. (1) In this Order-- |
||||||||||||
“the Principal Order” means the Air Navigation (Personnel Licensing) Order, 1966 ( S.I. No. 165 of 1966 ). |
||||||||||||
(2) “the Authority” means the Irish Aviation Authority. |
||||||||||||
(3) In this Order a reference to an enactment or order shall, unless the context otherwise requires, be construed as a reference to the enactment as amended, as extended by or under any subsequent enactment or order, including this Order. |
||||||||||||
3. The Principal Order is hereby amended-- |
||||||||||||
(a) by the deletion of Article 4 and the substitution of a new Article 4 as follows:-- |
||||||||||||
“4. (1) The Authority may give such directions in respect of such matters and things as may be specified in this Order for carrying out the purposes of this Order or the Schedules thereto as may be necessary and appropriate. |
||||||||||||
(2) Directions under this Order shall be given in the form of Aeronautical Notice, Aeronautical Information Circular, or by Notice sent by registered post to the person affected.” |

(b) by the insertion of the following paragraph in Article 19 of the Principal Order:-- |
||||||||||||
“(5) The Authority may approve courses of training for persons and may, subject to such conditions and requirements as may be prescribed in a direction under this Order, approve an organisation for the conduct of flight or ground training of persons, to include the training for aircraft type rating of pilots or aircraft engineers and may authorise such an organisation to conduct examinations or tests in accordance with paragraph (2) of this Article.” |

The purpose of this Order is to allow the issue of directions under any Article of or Schedule to the Order by removing the existing restriction to certain Articles only and to provide for the formal approval of pilot and engineer training organisations under the Order. |
