DIPLOMATIC AND CONSULAR FEES (AMENDMENT) (No. 2) REGULATIONS, 1999.

I, DAVID ANDREWS, Minister for Foreign Affairs, in exercise of the powers conferred on me by section 3 of the Diplomatic and Consular Officers (Provision of Services) Act, 1993 ( No. 33 of 1993 ), hereby, with the consent of the Minister for Finance, make the following Regulations:

1. (1) These Regulations may be cited as the Diplomatic and Consular Fees (Amendment) (No. 2) Regulations, 1999.

(2) The collective citation “the Diplomatic and Consular Fees Regulations, 1982 to 1999” shall include these Regulations.

(3) These Regulations shall come into operation on the 23rd day of July, 1999.

2. The Diplomatic and Consular Fees Regulations, 1982 ( S.I. No. 344 of 1982 ), are hereby amended:

(a) in Regulation 9 by the insertion of the following paragraph (e) after paragraph (d) of that Regulation:

“(e) in the case of the issue of a passport

(i) by the relevant Passport Office outside its normal hours of opening, or

(ii) by the relevant diplomatic mission or consular post outside its normal hours of opening for the purpose of providing such a service, where the citizen requesting the issue of a passport at that time does so due to circumstances constituting a genuine emergency as determined by the Minister.”

(b) in the Second Schedule, by the substitution for Part 1, as inserted by Regulation 2 of the Diplomatic and Consular Fees (Amendment) Regulations, 1996 ( S.I. No. 203 of 1996 ), of the following Part:

“Part I

For the issue of a passport of 32 pages to a person under 18 years of age or over 65 years of age, valid for three years.

For the issue of a new passport for the unexpired period of validity of an existing valid passport returned for cancellation or for endorsement

For the issue of an emergency travel document.

6.

For the issue of a passport:

(a) by the relevant Passport Office outside its normal hours of opening, or

(b) by the relevant diplomatic mission or consular post outside its normal hours of opening for the purpose of providing such a service, in addition to the applicable fee specified at reference numbers 1 to 3 in this Schedule.

N.B.--In these circumstances a passport valid for a restricted period may be issued, pending the subsequent issue of a passport valid for the full period applied for. The fees specified at reference numbers 38 and 39 in the First Schedule to these Regulations shall not be charged for the issue of a passport in these circumstances.

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

The purpose of these Regulations is

--to amend Regulation 9 of the 1982 Regulations to allow, in circumstances constituting a genuine emergency as determined by the Minister for Foreign Affairs, for the waiving of the fee chargeable for the issue of a passport by a Passport Office outside its normal hours of opening or by a diplomatic mission or consular post outside its normal hours of opening for the purpose of issuing passports and

--to amend Part 1 of the Second Schedule to the 1982 Regulations, as substituted by Regulation 2 of the Diplomatic and Consular Fees (Amendment) Regulations, 1996 ( S.I. No. 203 of 1996 ), to allow for the charging of a fee of £50 for the issue of a passport by a Passport Office outside its normal opening hours or by a diplomatic mission or consular post outside its normal opening hours for the purpose of issuing passports.
