DISTRICT COURT DISTRICTS AND AREAS (AMENDMENT) AND VARIATION OF DAYS (KILMALLOCK AND RATH LUIRC) ORDER, 2000.

DISTRICT COURT DISTRICTS AND AREAS (AMENDMENT) AND VARIATION OF DAYS (KILMALLOCK AND RATH LUIRC) ORDER, 2000.

The Courts Service, in exercise of the powers conferred on it by section 26 of the Courts of Justice Act, 1953 ( No. 32 of 1953 ), (as amended by section 43 of the Courts (Supplemental Provisions) Act, 1961 ( No. 39 of 1961 ) and section 16 of the Courts Act, 1971 ( No. 36 of 1971 )), and section 29 of the Courts Service Act, 1998 ( No. 8 of 1998 ), and after consultation with the President of the District Court, hereby orders as follows:

1. (1) This Order may be cited as the District Court Districts and Areas (Amendment) and Variation of Days (Kilmallock and Rath Luirc) Order, 2000.

(2) This Order shall come into operation on the 1st day of August, 2000.

2. In this Order--

“the order of 1998” means the District Court Districts and Areas (Amendment) and Variation of Days (No. 9) Order, 1998 ( S.I. No. 390 of 1998 );

“the Principal Order” means the District Court (Areas) Order, 1961 ( S.I. No. 5 of 1961 ).

3. The First Schedule of the Principal Order is hereby amended by--

(a) the deletion of the matter in columns (2), (3), (4), and (5) at reference number 50,

(b) the substitution for the matter in column (2) at reference number 152 of the following

“Counties of Limerick and Cork.”,

(c) the substitution for the matter in column (4) at reference number 152 (as amended by the Order of 1998) of the following

“Kilmallock--

Third Tuesday in each month at 11 a.m.

First Friday in each month at 11 a.m.

Third Friday in each month at 11 a.m.”.

(d) The substitution for the matter in column (5) at reference number 152 (as amended by the Order of 1998) of the following:

“The area comprising--

(a) the District Electoral Divisions of Ardpatrick, Ballymacshaneboy, Ballynabanogue, Bruree, Bulgaden, Colmanswell, Coolrus, Kilmallock, Rockhill, Tobernea, Ballylanders, Darragh, Duntrylague, Emlygrennan, Galbally, Glenbrohane, Griston, Kilfinnane, Kilflyn, Particles, and Riversdale in the county of Limerick, and

(b) the District Electoral Divisions of Ardskeagh, Rath Luirc, Dromina, Milltown, Newton and Springfort in the county of Cork.”.

4. The Second Schedule of the Principal Order is hereby amended by--

(a) the deletion of the matter in columns (2), (3), (4), and (5) at reference number 45,

(b) the substitution for the matter in column (2) at reference number 135 of the following

“Counties of Limerick and Cork.”,

(c) the substitution for the matter in column (4) at reference number 135 (as amended by the Order of 1998) of the following

“Kilmallock--

Third Tuesday in each month at 11 a.m.

First Friday in each month at 11 a.m.

Third Friday in each month at 11 a.m.”,

(d) The substitution for the matter in column (5) at reference number 135 (as amended by the Order of 1998) of the following

“The area comprising--

(a) the District Electoral Divisions of Ardpatrick, Ballymacshaneboy, Ballynabanogue, Bruree, Bulgaden, Colmanswell, Coolrus, Kilmallock, Rockhill, Tobernea, Ballylanders, Darragh, Duntryleague, Emlygrennan, Galbally, Glenbrohane, Griston, Kilfinnane, Kilflyn, Particles, and Riversdale in the county of Limerick, and

(b) the District Electoral Divisions of Ardskeagh, Rath Luirc, Dromina, Milltown, Newtown and Springfort in the county of Cork.”.

5. The Schedule to the District Court Areas (Amendment) Order, 1970 ( S.I. No. 161 of 1970 ), is hereby amended in column (4) at reference number 13 (as amended by the Order of 1998) by the deletion of--

(a) “Rath Luirc,”, and

(b) “50,”.

6. Business transacted in the District Court that is initiated and not completed before the commencement of this Order shall be continued and completed as if this Order had been in force at the time at which such business had been initiated.

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This order provides for the amalgamation of the District Electoral Divisions of Ardskeagh, Rath Luirc, Dromina, Milltown, Newtown and Springfort in the county of Cork, comprising the District Court Area of Rath Luirc (Charleville) with the District Court area of Kilmallock and provides for the holding of sittings of District Court in Kilmallock on the third Tuesday of each month and the first and third Friday of each month at 11 a.m.
