SOCIAL WELFARE (MISCELLANEOUS CONTROL PROVISIONS) (AMENDMENT) REGULATIONS, 2001

The Minister for Social, Community and Family Affairs, in exercise of the powers conferred on him by sections 4 (as amended by section 9 of the section 22 of the Social Welfare Act, 1998 ( No. 6 of 1998 )) of the Social Welfare (Consolidation) Act, 1993 (No. 27 of 1993) , hereby makes the following Regulations:

Citation.

1. (1) These Regulations may be cited as the Social Welfare (Miscellaneous Control Provisions) (Amendment) Regulations, 2001.

(2) These Regulations and the Social Welfare (Miscellaneous Control Provisions) Regulations, 1997 and 1998 shall be construed together as one and may be cited as the Social Welfare (Miscellaneous Control Provisions) Regulations, 1997 to 2001.

Records to be maintained.

2. Part IV of the Social Welfare (Miscellaneous Control Provisions) Regulations, 1997 ( S.I. No. 155 of 1997 ) is amended by -

(a) the substitution in article 16 for paragraph (c) of the following paragraph:

“(c) be held readily accessible at the construction site where the person to whom the record relates is employed for the duration of his or her employment.”, and

(b) the insertion after article 16 of the following article:

“17. In this Part ‘construction site’ means the premises or place at which the employee or sub-contractor is carrying out the work for which he is contracted.”.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations extend existing control provisions which require employers in the construction industry to maintain on-site records.
