I, Micheál Martin, Minister for Health and Children, in exercise of the powers conferred on me by section 5 of the Health (Miscellaneous Provisions) Act, 2001 (No. 14 of 2001) hereby order as follows:

1.       This Order may be cited as the Health (Miscellaneous Provisions) Act, 2001 , (Commencement) Order (No. 2), 2001.

2.       The 1st day of August, 2001 is hereby appointed as the day on which section 2 of the Health (Miscellaneous Provisions) Act, 2001 , shall come into operation.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

This Order appoints the 1st day of August, 2001 as the date for the coming into operation of section 2 of the Health (Miscellaneous Provisions) Act, 2001 . Section 2 amends section 3 of the Tobacco (Health Promotion and Protection) Act, 1988 ( No. 24 of 1988 ) and raises the age limit at which tobacco products can legally be sold to young persons from sixteen years to eighteen years. The maximum fine on persons convicted for selling to underage persons is also increased from £500 to £2000.
