REGULATIONS

OIREACHTAS (ALLOWANCES TO MEMBERS) AND MINISTERIAL AND PARLIAMENTARY OFFICES (AMENDMENT) ACT, 1992 (ALLOWANCES) (AMENDMENT) REGULATIONS, 2001


I, Charlie McCreevy, Minister for Finance, in exercise of the powers conferred on me by section 3(4), (as amended by section 19 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary, Judicial and Court Offices (Amendment) Act, 1998 ( No. 5 of 1998 ), and by section 37 of Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1992 (No. 3 of 1992) , hereby make the following regulations:

1.      These Regulations may be cited as the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1992 (Allowances) (Amendment) Regulations, 2001.

2.       (a)      Regulations 4 and 6 are to be taken to have come into operation on 6 June 1997.

(b)      Regulation 5 is to be taken to have come into operation on 1 January 2001.

3.      In these Regulations the “Principal Regulations” means the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1992 (Allowances) (No. 2) Regulations, 1992 ( S.I. No. 397 of 1992 ).

4.      The Principal Regulations are amended by inserting the following after Regulation 6:

“6A The rate of the allowance payable to the holder of the office of Attorney General while not a member of the Oireachtas, is with effect from 26 June 1997, the sum of £9,770 per year.”.

5.       Regulation 7 of the Principal Regulations is amended by substituting -

(a)      “£7,000” for “£5,120” in paragraph (1)(a)

(b)      “£7,000” for “£5,000” in paragraph (1)(b), and

(c)      “£3,500” for “£2,500” in paragraph (2).

6.      Regulation 8 of the Principal Regulations is amended in paragraph (1)(b) by substituting “5, 6 and 6A” for “5 and 6”.

These Regulations provide for the payment of an office holders expense allowance to an Attorney General who is not a member of the Oireachtas with effect from 26th June 1997 and for an increase in the constituency office allowances payable to members of Dáil Éireann.
