I, John O'Donoghue, T.D., Minister for Justice, Equality and Law Reform, in exercise of the powers conferred on me by section 14 of the Police Forces Amalgamation Act, 1925 ( No. 7 of 1925 ) (as adapted by the Justice (Alteration of Name of Department and Title of Minister) Order, 1997 ( S.I. No. 298 of 1997 )), and with the approval of the Government, hereby make the following regulations: |

1. (1) These Regulations may be cited as the Garda Síochána (Promotion) (Amendment) Regulations, 2001. |
||||||
(2) These Regulations shall come into operation on 9th August, 2001. |
||||||
2. The Interpretation Act, 1937 (No. 38 of 1937) , applies to these Regulations. |
||||||
3. The Garda Síochána (Promotion) Regulations, 1987 ( S.I. No. 39 of 1987 ), are hereby amended by the substitution of the following Regulation for Regulation 6: |
||||||
“6. (1) The selection of members for promotion to the rank of assistant commissioner shall be made in accordance with this Regulation. |
||||||
(2) The Commissioner shall, not later than 15 days before the holding of a competition under this Regulation, provide each member (who, upon the date on which it is proposed that the competition will commence, will have served not less than 2 years at the rank of Chief Superintendent) with a description in writing of the role of assistant commissioner and a statement in writing of the competencies required for the carrying out of the duties of assistant commissioner. |

(3) A member to whom paragraph (2) relates may apply for promotion to the rank of assistant commissioner; and a member who so applies is in this Regulation referred to as an ‘applicant’. |

(4) A competition for promotion to the rank of assistant commissioner shall consist of an interview or such number of interviews, as the interview board concerned considers appropriate, of each applicant. |
||||||
(5) An interview board referred to in paragraph (4) shall comprise - |
||||||
(a) the Commissioner, |
||||||
(b) a deputy commissioner, |
||||||
(c) a person nominated by the body commonly known as the Top Level Appointments Committee, and |
||||||
(d) a person nominated by the body commonly known as the Civil Service and Local Appointments Commissioners. |
||||||
(6) An application for a promotion to which this Regulation applies shall be in such form as the Commissioner may determine. |
||||||
(7) Each applicant shall be provided with copies of all reports, assessments, evaluations, notes and other records relating to him or her that - |
||||||
(a) have been created, or |
||||||
(b) it is intended will be referred to, |
||||||
for the purposes of a competition under this Regulation.” |
||||||
The Government hereby approve the making of these Regulations. |
