Company Law Enforcement Act, 2001 (Section 34) Regulations, 2001

I, Mary Harney, Minister for Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 4 of the Company Law Enforcement Act, 2001 ( No. 28 of 2001 ), make the following Regulations:

1.   These Regulations may be cited as the Company Law Enforcement Act, 2001 (Section 34) Regulations, 2001.

2.   The following bodies namely:

Kentford Securities Limited,

Celtic Helicopters Limited,

Hamilton Ross Company Limited,

College Trustees Limited, and

Guinness & Mahon (Ireland) Limited,

are prescribed for the purposes of section 34 of the Company Law Enforcement Act, 2001 ( section 19 of the Companies Act, 1990 ( No. 33 of 1990 ) before the passing of the Company Law Enforcement Act, 2001 .

3.   The extent to which the said Gerard Ryan may continue to exercise the powers referred to in the said section 34 is prescribed as the extent that is necessary to enable him to complete his examination of the books and documents of the bodies specified in Regulation 2 of these Regulations.

(This note is not part of the instrument and does not purport to be a legal interpretation)

These Regulations allow for the examination of books and documents of certain companies authorised under Section 19 of the Companies Act, 1990 as amended by Section 34 of the Company Law Enforcement Act, 2001 to be continued by the authorised officer for a period after the commencement of Section 34 of the Company Law Enforcement Act, 2001
