District Court (Taxi Regulation) Rules 2006

The District Court Rules Committee, in exercise of the powers conferred on them by section 91 of the section 72 of the section 34 of the section 24 of the Interpretation Act 2005 , do hereby, with the concurrence of the Minister for Justice, Equality and Law Reform, make the following rules of court:-

1.   These rules may be cited as the District Court (Taxi Regulation) Rules 2006.

2.   These rules shall come into operation on the 19th day of June 2006 and shall be read together with all other District Court rules for the time being in force.

3.   The District Court Rules 1997 ( S.I. No.93 of 1997 ) shall be amended by the insertion immediately following rule 6 of Order 97 of the following:

-�Taxi Regulation Act 2003

7.  (1)        In this rule, -�licensing authority-� has the same meaning as in the Taxi Regulation Act 2003 (No. 25 of 2003).

(2)             An application under section 36(2) of the section 34 of the section 82 of the Road Traffic Act 1961 ) on the Commission for Taxi Regulation or other licensing authority which granted the licence at least twenty one days before the date fixed for the hearing of the application. The stamped original of the notice of application together with a statutory declaration as to service thereof shall be lodged with the Clerk at least four clear days before the date fixed for the hearing of the application. The order of the Court made on any such application shall be in the Form 97.24 Schedule C and the Clerk shall send a copy of such order to the Superintendent of the Garda Síochána for the district in which the applicant ordinarily resides and to the Commission for Taxi Regulation or other licensing authority as appropriate.-�

4.   The Forms numbered 97.23 and 97.24 inclusive in the Schedule hereto shall be added to the Forms in Schedule C of the District Court Rules 1997 ( S.I. No. 93 of 1997 ).
