SAFETY, HEALTH AND WELFARE AT WORK (CONSTRUCTION) (AMENDMENT) REGULATIONS 2008

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 6th May, 2008.

I, BILLY KELLEHER, Minister of State at the Department of Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 58 of the Safety, Health and Welfare at Work Act 2005 (No. 10 of 2005) and the Enterprise, Trade and Employment (Delegation of Ministerial Functions) (No. 3) Order 2007 ( S.I. No. 561 of 2007 ), and after consultation with the Health and Safety Authority, hereby make the following regulations:

1. These Regulations may be cited as the Safety, Health and Welfare at Work (Construction) (Amendment) Regulations 2008.

2. The Safety, Health and Welfare at Work (Construction) Regulations 2006 ( S.I. No. 504 of 2006 ) are amended by-

(a) the substitution of the following paragraph for paragraph (13) of Regulation 1:

“ (13) Regulations 19(1)(b), 25(1)(b), 29(1)(g), 74(e) and 97(b) and (c) shall-

(a) in respect of the tasks specified in clauses (e) and (n) of paragraph 1(1) of Schedule 4, apply from 6 May 2008, and

(b) in respect of the tasks specified in clauses (c), (r), (s) and (t) of that paragraph, apply from 6 July 2009.”, and

(b) the substitution of the following clause for clause (n) of paragraph 1(1) of Schedule 4:

“(n) Mini-digger operation - where the employee has not been trained in the task specified in clause (o);”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

The purpose of these Regulations is to amend the Safety, Health and Welfare at Work (Construction) Regulations 2006 ( S.I. No. 504 of 2006 ) as regards the operational date for Regulations 19(1)(b), 25(1)(b), 29(1)(g), 74(e) and 97(b) and (c), which is changed from 6 May 2008 to 6 July 2009, in respect of the possession of a Construction Skills Registration Card under the Construction Skills Certification Scheme, as it applies to the following tasks-

(i)Mobile tower scaffold (where the employee has not been trained in basic or advanced scaffolding),

(ii)Signing, lighting and guarding on roads,

(iii)Locating under-ground services, and

(iv)Shotfiring,

which are listed at paragraphs 1(1)(c), (r), (s) and (t) of Schedule 4 to the 2006 Regulations.

These Regulations also rectify a typographical error in paragraph 1(1)(n) of Schedule 4 to the 2006 Regulations.
