VIDEO RECORDINGS ACT 1989 (FEES) (AMENDMENT) REGULATIONS 2008

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 26th September, 2008.

I, DERMOT AHERN, Minister for Justice, Equality and Law Reform, in exercise of the powers conferred on me by sections 3 and 31 (as amended by Part 9 of the Civil Law (Miscellaneous Provisions) Act 2008 (No. 14 of 2008)) of the Video Recordings Act 1989 (No. 22 of 1989), as adapted by the Justice (Alteration of Name of Department and Title of Minister) Order 1997 ( S.I. No. 298 of 1997 ), and with the consent of the Minister for Finance, hereby make the following regulations:

1. (1) These Regulations may be cited as the Video Recordings Act 1989 (Fees) (Amendment) Regulations 2008.

(2) These Regulations come into operation on 1st October, 2008.

2. Regulation 3 of the Video Recordings Act 1989 (Fees) Regulations 2004 ( S.I. No. 113 of 2004 ) is amended:

(a) by the substitution of “subject to paragraphs (1A) to (4),” for “Subject to paragraphs (2) to (4),” in paragraph (1);

(b) by inserting the following paragraph after paragraph (1):

“(1A) where a video recording containing the video work in respect of which the application for a supply certificate is being made is to be released for letting on hire or for sale to the ultimate consumer and the video work concerned is a video work to which subparagraph (i) or (ii) of section 31(3)(b) (inserted by section 69(q) of the Civil Law (Miscellaneous Provisions) Act 2008 (No. 14 of 2008)) refers, €2.50 per minute;”.

The Minister for Finance consents to the making of the foregoing Regulations.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations prescribe the fees to be charged in relation to applications for supply certificates under Section 3 in the case of video works that are likely to appeal only to a limited or specialist audience, or are likely to be distributed for charitable purposes.
