S.I. No. 295/2010 - Social Welfare (Consolidated Supplementary Welfare Allowance) (Amendment) (Rent Supplement) Regulations 2010. 2010 295

Notice of the making of this Statutory Instrument was published in

"Iris Oifigiúil" of 22nd June, 2010.

The Minister for Social Protection, in exercise of the powers conferred on him by sections 4 and 198 (as amended by section 14 of the Social Welfare and Pensions (No. 2) Act 2009 (No. 43 of 2009)) of the Social Welfare Consolidation Act 2005 (No. 26 of 2005), hereby makes the following Regulations:

Citation and construction.

1. (1) These Regulations may be cited as the Social Welfare (Consolidated Supplementary Welfare Allowance) (Amendment) (Rent Supplement) Regulations 2010.

(2) These Regulations shall be construed as one with the Social Welfare (Consolidated Supplementary Welfare Allowance) Regulations 2007 (S.I. No. 412 of 2007) and shall be included in the collective citation "the Social Welfare (Consolidated Supplementary Welfare Allowance) Regulations 2007 to 2010".

Commencement.

2. These Regulations come into operation on 16 June 2010.

Definitions.

3. In these Regulations the "Principal Regulations" mean the Social Welfare (Consolidated Supplementary Welfare Allowance) Regulations 2007 (S.I. No. 412 of 2007).

Maximum amount of rent in respect of which a supplement is payable.

4. The Principal Regulations are amended in paragraph (i) of article 9(2) (as amended by the Social Welfare (Consolidated Supplementary Welfare Allowance) (Amendment) (Rent Supplement) Regulations 2009 ( S.I. No. 202 of 2009 )) by substituting the following for sub-paragraph (iii):

"(iii) the rent payable by the claimant is just and proper having regard to the nature, character and location of the residence,

and for this purpose, the appropriate maximum amount of rent in respect of which a supplement is payable for the period commencing on 16 June 2010 and ending on 31 December 2011, shall be-

(I) the monthly amount set out in Schedule 1 to the Regulations in respect of such class or classes of persons referred to in row (1) of the said Schedule, and

(II) the amount as determined by the Minister in respect of any other class or classes of persons,

having regard to the family circumstances and the location of the residence of such persons, and"

Entitlement to rent supplement.

5. The Principal Regulations are amended by the substitution for Schedule 1 of the following Schedule:

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These regulations provide for a reduction of the levels of maximum rent until 31st December 2011, as set out in Schedule 1 of the Social Welfare (Consolidated Supplementary Welfare Allowance) Regulations 2007 (S.I. No. 412 of 2007), in respect of which rent supplement is paid.

These measures come into operation on 16 June 2010.
