I, NOEL DEMPSEY, Minister for Transport, in exercise of the powers conferred on me by section 42(3)(n) (inserted by section 10 of the Road Traffic Act 2006 (No. 23 of 2006)) of the Road Traffic Act 1961 (No. 24 of 1961) and the National Roads and Road Traffic (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 298 of 2002 ) (as adapted by the Public Enterprise (Alteration of the Name of Department and Title of Minister) Order 2002 ( S.I. No. 305 of 2002 )), hereby make the following regulations: |

1. These Regulations may be cited as the Road Traffic (Licensing of Learner Drivers) (Certificates of Competency) (Amendment) Regulations 2010. |
||
2. The Road Traffic (Licensing of Learner Drivers) (Certificates of Competency) Regulations 2007 ( S.I. No. 725 of 2007 ) are amended by inserting after Regulation 2 the following: |

"3.Regulation 2 does not apply to a person who is granted a learner permit for a category of vehicle referred to in that Regulation and who holds a driving licence or permit corresponding to that category issued by the competent authority of another jurisdiction (not being a driving licence or a permit issued to enable the person to learn or provisionally to drive such a vehicle) which shows that the person has had an entitlement to drive in that category for a period of at least 6 months.". |

These Regulations remove the requirement to hold a learner permit for at least six months before sitting a driving test from holders of full driving licences from other jurisdictions. |
