S.I. No. 518/2010 - Adoption Act 2010 (Section 85) (Fees) Regulations 2010.

Notice of the making of this Statutory Instrument was published in

"Iris Oifigiúil" of 5th November, 2010.

I, BARRY ANDREWS, Minister of State at the Department of Health and Children, in exercise of the powers conferred on me by section 150 of the Adoption Act 2010 (No. 21 of 2010) and the Health and Children (Delegation of Ministerial Functions) Order 2010 ( S.I. No. 508 of 2010 ), hereby make the following regulations:

1. These regulations may be cited as the Adoption Act 2010 (Section 85) (Fees) Regulations 2010.

2. These regulations come into operation on 2 November 2010.

3. (1)(a) The amount of €2 is prescribed as the fee payable to an tArd-Chláraitheoir under paragraph (a) of section 85(2) of the Adoption Act 2010 for a particular search in the index to the Adopted Children Register.

(b) The amount of €20 is prescribed as the fee payable to an tArd-Chláraitheoir under that paragraph for a general search in that index.

(c) For the purposes of this regulation, a "particular search" means a search over any period not exceeding five years for any particular entry in the register and a "general search" means a search, not exceeding seven consecutive hours over any period exceeding five years.

(2) The amount of €8 is prescribed as the fee payable to an tArd-Chláraitheoir under paragraph (b) of that section for a copy certified by him or her of an entry in the Register.

(3) The amount of €4 is prescribed as the fee payable to an tArd-Chláraitheoir under that paragraph for a copy (not being a copy so certified) of such an entry.

(4) The amount of €8 is prescribed as the fee payable to an tArd-Chláraitheoir under that paragraph for a certified extract of such an entry.

(5) The amount of €2 is prescribed as the fee payable to an tArd-Chláraitheoir under paragraph (a) of section 85(3) of the said Act for a search by him or her in the Register or in the index to it.

(6) The amount of €8 is prescribed as the fee payable to an tArd-Chláraitheoir under paragraph (b) of that section for a copy certified by him or her to be a true copy of an entry in the Register.

(7) The amount of €4 is prescribed as the fee payable to an tArd-Chláraitheoir under that paragraph for a copy (not being a copy so certified) of such an entry.

(8) The amount of €8 is prescribed as the fee payable to an tArd-Chláraitheoir under that paragraph for a certified extract of such an entry.
