S.I. No. 161/2012 - Student Support Act (Appointment of Awarding Authority) Order 2012.

Notice of the making of this Statutory Instrument was published in

"Iris Oifigiúil" of 25th May, 2012.

I, RUAIRI QUINN, Minister for Education and Skills, in exercise of the powers conferred on me by section 9(1) of the Student Support Act 2011 (No. 4 of 2011), having complied with section 9(4) of that Act, and with the consent of the Minister for Public Expenditure and Reform, hereby order as follows:

1. This Order may be cited as the Student Support Act (Appointment of Awarding Authority) Order 2012.

2. This Order comes into operation on 22 May 2012.

3. In this Order-

"appointed awarding authority" shall be construed in accordance with Article 4;

"Principal Act" means the Student Support Act 2011 (No. 4 of 2011);

"transferring awarding authority" means an awarding authority specified in the Schedule.

4. The City of Dublin Vocational Education Committee is the awarding authority appointed as the appointed awarding authority to perform all of the functions (other than those functions referred to in Article 5) of a transferring awarding authority.

5. Subject to the Principal Act a transferring awarding authority shall, in relation to a student who under the Principal Act was prior to the coming into operation of this Order in receipt of a grant from the transferring awarding authority, continue to perform all of the functions of an awarding authority in relation to the student until he or she has completed the course in respect of which he or she was awarded the grant.

6. Within a period of 14 days of the receipt by the transferring awarding authority of a request from the appointed awarding authority, a transferring awarding authority shall provide to the appointed awarding authority such records, data or information or a class of such records, data or information as relate to a function transferred to the appointed awarding authority.
