I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 36 of the Animal Health and Welfare Act 2013 (No. 15 of 2013), hereby make the following regulations: |
||
1. These Regulations may be cited as the Animal Health and Welfare (Restriction on horned cattle) Regulations 2014 and come into operation on 6 March 2014. |
||
2. A person shall not sell by public sale or supply, export or expose for export any horned cattle. |
||
3. Regulation 2 does not apply to- |
||
(a) a bull entered in a herd book, |
||
(b) an animal that has been seized and detained or forfeited under the Animal Health and Welfare Act 2013 or other enactment being disposed of by or under the direction of an authorized officer, |
||
(c) an animal that is being sold in accordance with an animal health and welfare notice, or |
||
(d) a pedigree female- |
||
(i) sold at a public sale which is for the sale of pedigree breeding stock only, |
||
(ii) sold at a sale for the dispersal of a herd of pedigree cattle, |
||
(iii) privately sold ex-farm for breeding purposes, |
||
(iv) from a pedigree herd that is sold for immediate slaughter, or |
||
(v) exported for breeding purposes. |
||
(e) A horned animal that is transported separately from non-horned animals and from any horned animals other than those of a compatible and familiar group, and is at all times during any private or public sale kept segregated from non-horned animals and from any horned animals other than those of a compatible and familiar group. |
||
4. Regulation 2 is a penal provision to which section 36 (4)(b) of the Animal Health and Welfare Act 2013 applies. |
