I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 36 of the Animal Health and Welfare Act 2013 (No. 15 of 2013) and, in relation to Regulation 5 of these Regulations, section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Decision 2013/426/EU of 5 August 20131 , hereby make the following regulations: |

1. These Regulations may be cited as the Animal Health (African Swine Fever) (Non-EU Countries) Regulations 2014 and come into operation on 6 March 2014. |
||
2. (1) In these Regulations- |
||
"Commission Decision" means Commission Decision 2013/426/EU of 5 August 2013; |
||
"livestock vehicle" means any vehicle being used or which has been used to transport live animals or animal feed. |
||
(2) A word or expression that is used in the Commission Decision and is also used in these Regulations has, in these Regulations, the same meaning as in the Commission Decision. |
||
3. A person shall not bring a livestock vehicle into the State from a third country listed in Annex 1 to the Commission Decision unless it has been cleansed and disinfected after the last unloading of live animals or animal feed and is accompanied by a certificate in the form set out in Annex II to the Commission Decision signed by the driver or operator, which is presented to an authorised officer at the point of entry. |
||
4. Regulation 3 is a penal provision to which section 36 (4)(b) of the Animal Health and Welfare Act 2013 applies. |
||
5. The European Union (African Swine Fever) (Non-EU Countries) Regulations 2013 ( S.I. No. 325 of 2013 ) are revoked. |
