Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 3rd April, 2015.

I, Alan Kelly, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by section 12 (1) of the Water Services (No. 2) Act 2013 (No. 50 of 2013), hereby make the following order:

1. This Order may be cited as the Water Services (No. 2) Act 2013 (Property Vesting Day) (No. 3) Order 2015.

2. In this Order-

“the Act” is the “ Water Services (No. 2) Act 2013 (No. 50 of 2013);

3. The 8th of April 2015 shall be a “property vesting day” for the purposes of section 12 of the Act.

4. On the property vesting day referred to in article 3, the following property, which immediately before this day was vested in a water services authority, shall stand vested in Irish Water:

(i) Any moneys received or due to be received, in accordance with section 48 or 49 of the Planning and Development Act 2000 , which relates to a function transferred to Irish Water in accordance with section 7 of the Act; and

(ii) Any money due to be received by a water services authority relating to charges levied under section 2 of the Local Government (Financial Provisions) (No. 2) Act 1983 or section 65A of the Public Health Act 1878, which relate to a function which transferred to Irish Water in accordance with section 7 of the Act.

(This note is not part of the Instrument and does not purport to be a legal interpretation).

This Statutory Instrument gives effect to the decision of the Minister for the Environment, Community and Local Government to transfer the property listed in the Order from each water services authority to Irish Water in accordance with section 12 of the Water Services (No. 2) Act 2013 .
