Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 17th July, 2015.

I, BRENDAN HOWLIN, Minister for Public Expenditure and Reform, in exercise of the powers conferred on me by section 4 (2) of the Valuation Act 2001 (No. 13 of 2001) and the Finance (Transfer of Departmental Administration and Ministerial Functions) Order 2011 ( S.I. No. 418 of 2011 ), hereby make the following regulations:

1. (1) These Regulations may be cited as the Valuation Act 2001 (Appeal to Tribunal) (Fees) Regulations 2015.

(2) These Regulations come into operation on 20 July 2015.

2. In these Regulations “Act of 2001” means Valuation Act 2001 (No. 13 of 2001).

3. There shall be charged by the Tribunal in respect of an appeal under section 34 (as amended by section 18 of the Valuation Act 2015) of the Act of 2001-

(a) where the property concerned is on an existing valuation list, the fee set out in column (3) opposite the value of the property referred to in column (2) at a reference number in column (1), of Part 1 of the Schedule, or

(b) where the property concerned is on a valuation list, the fee set out in column (3) opposite the value of the property referred to in column (2) at a reference number in column (1), of Part 2 of the Schedule.

4. The following are revoked:

(a) the Valuation Tribunal (Fees) Regulations 2002 ( S.I. No. 312 of 2002 );

(b) the Valuation Tribunal (Revaluation Appeals) (Fees) Regulations 2008 ( S.I. No. 18 of 2008 ).
