Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 30th October, 2015.

I, ALAN KELLY, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by section 18 (1) of the Water Services (No. 2) Act 2013 (No. 50 of 2013), hereby make the following order:

1. This Order may be cited as the Water Services (No. 2) Act 2013 (Other Licences, Authorisations and Permits) Order 2015.

2. In this Order-

“the Act” is the “ Water Services (No. 2) Act 2013 (No. 50 of 2013)”.

3. The 30th of October 2015 is appointed for the purposes of section 18 of the Act.

4. From the day referred to in article 3, any authorisation or approval issued to a water services authority under sections 175 , 177AE, 179 and 226 of the Planning and Development Act 2000 , and which relate to a function transferred to Irish Water by section 7 of the Act, shall continue in force for the unexpired period of the authorisation as if issued to Irish Water.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

This Statutory Instrument gives effect to the decision of the Minister for the Environment, Community and Local Government to designate that planning authorisations issued under the Planning and Development Act 2000 to a water services authority shall continue in force as if granted to Irish Water for the unexpired period of the authorisation.
