I, KATHERINE ZAPPONE, Minister for Children and Youth Affairs, in exercise of the powers conferred on me by section 150 of the Adoption Act 2010 (No. 21 of 2010) and the Office of the Minister for Children and Youth Affairs (Transfer of Departmental Administration and Ministerial Functions) Order 2011 ( S.I. No. 218 of 2011 ), hereby make the following regulations: | ||
1. These Regulations may be cited as the Adoption Act 2010 (Section 85) (Fees) Regulations 2017. | ||
2. These Regulations come into operation on 4 December 2017. | ||
3. In these Regulations “Principal Act” means the Adoption Act 2010 (No. 21 of 2010). | ||
4. (1) The amount of €20 is prescribed as the fee payable to an tArd-Chláraitheoir under section 85(2)(b) and (3)(b) of the Principal Act for each certified copy or certified extract of an entry in the Adopted Children Register given by An tArd-Chláratheoir pursuant to either of those provisions. | ||
(2) The amount of €4 is prescribed as the fee payable to an tArd-Chláraitheoir under section 85(2)(b) and (3)(b) of the Principal Act for each copy of an entry in the Adopted Children Register given by an tArd-Chláraitheoir pursuant to either of those provisions. | ||
5. (1) The amount prescribed as the fee payable to an tArd-Chláraitheoir under section 85(2)(a) of the Principal Act for each search of the index to the Adopted Children Register carried out by an tArd-Chláraitheoir pursuant to that provision is— | ||
(a) where the period of time between the search dates specified for the search is 5 years or less, €2, and | ||
(b) where the period of time between the search dates specified for the search is greater than 5 years and the time taken to conduct the search does not exceed 7 consecutive hours, €20. | ||
(2) The amount prescribed as the fee payable to an tArd-Chláraitheoir under section 85(3)(a) of the Principal Act for each search of the Adoption Children Register and the index to that Register carried out by an tArd-Chláraitheoir pursuant to that provision is— | ||
(a) where the period of time between the search dates specified for the search is 5 years or less, €2, and | ||
(b) where the period of time between the search dates specified for the search is greater than 5 years and the time taken to conduct the search does not exceed 7 consecutive hours, €20. | ||
6. The Adoption Act 2010 (Section 85) (Fees) Regulations 2010 ( S.I. No. 518 of 2010 ) are revoked. | ||

EXPLANATORY NOTE | ||
(This note is not part of the Instrument and does not purport to be a legal interpretation.) | ||
These Regulations set the fees required to be paid for— | ||
• obtaining copies or extracts of entries in the Adopted Children Register, and | ||
• searching the index of the Adopted Children Register. | ||
These Regulations may be cited as the Adoption Act 2010 (Section 85) (Fees) Regulations 2017 and come into operation on 4 December 2017. |
