S.I. No. 281/2020 - Statistics (Census of Agriculture) Order 2020


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 4th August, 2020.

I, MICHEÁL MARTIN, Taoiseach in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993) and, other than in relation to paragraph 2(f) of the Schedule to the following order, for the purpose of giving full effect to Regulation (EU) 2018/1091 of the European Parliament and of the Council of 18 July 20181 , hereby orders as follows:

1. This Order may be cited as the Statistics (Census of Agriculture) Order 2020.

2. (1) In this Order -

“farmer” means-

(a) a person in charge of a farm to whom a herd number is for the time being allocated by an officer of the Minister for Agriculture, Food and the Marine, and

(b) a person, other than a person referred to in paragraph (a), in charge of a farm where horticultural produce is grown;

“Regulation” means Regulation (EU) 2018/1091 of the European Parliament and of the Council of 18 July 20181 ;

“Regulation (EC) No. 1893/2006” means Regulation (EC) No. 1893/2006 of the European Parliament and of the Council of 20 December 20062 , as amended by Regulation (EC) No. 295/2008 of the European Parliament and of the Council of 11 March 20083 , Regulation (EU) No. 70/2012 of the European Parliament and of the Council of 18 January 20124 and Regulation (EU) 2019/1243 of the European Parliament and of the Council of 20 June 20195 ;

“relevant economic activity” means an activity that is classified for statistical purposes-

(a) in group 01.1, 01.2, 01.3 or 01.5 of NACE Rev. 2 set out in Annex I to Regulation (EC) No. 1893/2006,

(b) in class 01.41, 01.42, 01.43, 01.44, 01.45, 01.46 or 01.47 of NACE Rev. 2 set out in Annex I to Regulation (EC) No. 1893/2006,

(c) in class 01.49 of NACE Rev. 2 set out in Annex I to Regulation (EC) No. 1893/2006 in so far as the activity constitutes-

(i) the raising of semi-domesticated or other live animals, other than insects, or

(ii) the breeding of semi-domesticated or other live animals,

or

(d) in group 01.6 of NACE Rev. 2 set out in Annex I to Regulation (EC) No. 1893/2006 in so far as the activity constitutes the maintenance of agricultural land in good agricultural and environmental condition;

“survey” means the Census of Agriculture that is conducted by the Central Statistics Office for the purpose of obtaining information specified in the Schedule, including for the purpose of compliance with the Regulation.

(2) A word or expression that is used in this Order and is also used in the Regulation has the same meaning in this Order as in the Regulation, except where the context otherwise requires.

3. (1) This Article applies to a farmer who is not engaged in relevant economic activity on 1 September 2020.

(2) A requirement on farmers to whom this Article applies to provide, for the purposes of the survey, information the general nature of which is specified in paragraphs 1 and 3 of the Schedule, is hereby prescribed.

4. (1) This Article applies to a farmer who is engaged in relevant economic activity on 1 September 2020.

(2) A requirement on farmers to whom this Article applies to provide, for the purposes of the survey, information the general nature of which is specified in paragraphs 2 to 4 of the Schedule, is hereby prescribed.

SCHEDULE

1. Information regarding the following, as it relates to the farmer concerned on 1 September 2020:

(a) whether the farm of which he or she is in charge has been transferred, sold, let or leased or is temporarily idle;

(b) whether he or she is retired from all relevant economic activity.

2. Information regarding the following, as it relates to the farmer concerned on 1 September 2020:

(a) where he or she is a person to whom paragraph (a) of the definition of farmer applies, his or her current and where applicable, previous, herd number;

(b) whether the farm of which he or she is in charge is-

(i) his or her sole responsibility,

(ii) in a registered farm partnership,

(iii) in a non-registered farm partnership, or

(iv) a legal entity;

(c) the management of the farm of which he or she is in charge, including-

(i) the category of person who manages the farm,

(ii) the year the person referred to in clause (i) took up their role, and

(iii) the level of agricultural training undertaken by the person referred to in clause (i);

(d) whether he or she holds cattle, sheep, goats, poultry or pigs and, if so, the total number of each type so held and in the case of sheep, the age of same;

(e) whether he or she holds thoroughbred horses, other horses and ponies, mules, jennets, asses, deer or other livestock;

(f) where he or she holds livestock of any type referred to in subparagraph (e), the total number of each type so held;

(g) the area farmed, including-

(i) the total area owned by him or her,

(ii) the total area of land rented in and land rented out by him or her,

(iii) the total area of woodland and forest,

(iv) the total area of unused agricultural land,

(v) the total area of non-agricultural land, and

(vi) the total area of land used by him or her for relevant economic activities;

(h) the total area, in the period commencing on 1 April 2020 and ending on 1 September 2020, of temporary and permanent grassland on the farm of which he or she is in charge by reference to use for silage, hay or pasture and the total area of land on that farm in that period used for rough grazing.

3. The eircode of the farm of which the farmer concerned is in charge and his or her contact details.

4. Information on the time taken to complete the questionnaire, form or other record prepared by the Director General for the collection of the information referred to in paragraphs 2 and 3.
