S.I. No. 51/2021 - Public Service Pay and Pensions Act 2017 (Payments to Community Pharmacy Contractors) (Amendment) Regulations 2021


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 26th February, 2021.

I, STEPHEN DONNELLY, Minister for Health, in exercise of the powers conferred on me by section 42 of the Public Service Pay and Pensions Act 2017 (No. 34 of 2017), being satisfied that subsection (6) of that section has been complied with; having complied with subsection (9) of that section; having had regard to the matters specified in paragraphs (a) to (e) of subsection (10) of that section, with the consent of the Minister for Public Expenditure and Reform, hereby make the following regulations:

1. These Regulations may be cited as the Public Service Pay and Pensions Act 2017 (Payments to Community Pharmacy Contractors) (Amendment) Regulations 2021.

2. The Public Service Pay and Pensions Act 2017 (Payments to Community Pharmacy Contractors) Regulations 2019 ( S.I. No. 639 of 2019 ) are amended -

(a) in Regulation 3, by the substitution of “the Health (Amendment) Act 1996 Scheme, the High Tech Medicinal Products Scheme and the National Influenza Immunisation Programme” for “the Health (Amendment) Act 1996 Scheme and the High Tech Medicinal Products Scheme”,

(b) in Regulation 4, by the substitution of “Subject to Regulation 5, the payments” for “The payments”,

(c) by the insertion of the following Regulation after Regulation 4:

“5. The payments that shall be made to a community pharmacy contractor in respect of the services rendered by the community pharmacy contractor to or on behalf of the Health Service Executive under the National Influenza Immunisation Programme referred to in Regulation 3 on and from the day on which the Public Service Pay and Pensions Act 2017 (Payments to Community Pharmacy Contractors) (Amendment) Regulations 2021 ( S.I. No. 51 of 2021 ) come into operation shall be those specified in Schedule 6.”, and

(d) by the insertion of the following Schedule after Schedule 5:

“SCHEDULE 6

Amounts payable under the National Influenza Immunisation Programme

Amount payable for administering an influenza vaccine to a person in an at-risk group of persons specified in Circular titled ‘Pharmacy Circular 029/18’ dated 20 September 2018.

€15.00

2.

Additional amount payable for every ten persons in an at-risk group of persons specified in Circular titled ‘Pharmacy Circular 029/18’ dated 20 September 2018 to whom the community pharmacy contractor has administered an influenza vaccine.

€100.00

3.

Amount payable for administering a Live Attenuated Influenza Vaccine (LAIV) to a child aged 2 years or more and less than 18 years.

€20.00

4.

Additional amount payable for every ten children aged 2 years or more and less than 18 years to whom the community pharmacy contractor has administered a Live Attenuated Influenza Vaccine (LAIV).

€150.00

The Minister for Public Expenditure and Reform consents to the foregoing Regulations.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations shall apply to payments in respect of services rendered by a Community Pharmacist to or on behalf of the Health Service Executive under and in accordance with the terms of the National Immunisation Programme.
