I, MICHEÁL MARTIN, Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993) and for the purpose of giving full effect to Council Regulation (EC) No. 1165/98 of 19 May 19981 , as amended by Regulation (EC) No 1882/2003 of the European Parliament and of the Council of 29 September 20032 , Regulation (EC) No. 1158/2005 of the European Parliament and of the Council of 6 July 20053 , Commission Regulation (EC) No 1503/2006 of 28 September 20064 , Regulation (EC) No. 1893/2006 of the European Parliament and of the Council of 20 December 20065 , Commission Regulation (EC) No. 1178/2008 of 28 November 20086 , Commission Regulation (EC) No 329/2009 of 22 April 20097 , Regulation (EC) No 596/2009 of the European Parliament and of the Council of 18 June 20098 and Commission Regulation (EU) No 461/2012 of 31 May 20129 , in so far as it relates to Annex B thereto, hereby order as follows:

1. This Order may be cited as the Statistics (Quarterly Survey of Construction) (No. 2) Order 2021.

2. (1) In this Order -

“quarter” means a period of 3 months ending on 31 March, 30 June, 30 September or 31 December in any year;

“Regulation” means Council Regulation (EC) No. 1165/98 of 19 May 19981 as amended by Regulation (EC) No 1882/2003 of the European Parliament and of the Council of 29 September 20032 , Regulation (EC) No. 1158/2005 of the European Parliament and of the Council of 6 July 20053 , Commission Regulation (EC) No 1503/2006 of 28 September 20064 , Regulation (EC) No. 1893/2006 of the European Parliament and of the Council of 20 December 20065 , Commission Regulation (EC) No. 1178/2008 of 28 November 20086 , Commission Regulation (EC) No 329/2009 of 22 April 20097 , Regulation (EC) No 596/2009 of the European Parliament and of the Council of 18 June 20098 and Commission Regulation (EU) No 461/2012 of 31 May 20129 ;

“Regulation (EC) No. 1893/2006” means Regulation (EC) No. 1893/2006 of the European Parliament and of the Council of 20 December 20065 as amended by Regulation (EC) No. 295/2008 of the European Parliament and of the Council of 11 March 200810 , Regulation (EU) No. 70/2012 of the European Parliament and of the Council of 18 January 201211 and Regulation (EU) 2019/1243 of the European Parliament and of the Council of 20 June 201912 ;

“survey” means the Quarterly Survey of Construction that is conducted by the Central Statistics Office for the purposes of obtaining from persons or undertakings to which this Order applies information specified in the Schedule, including for the purposes of compliance with the Regulation, in so far as it relates to Annex B thereto.

(2) A word or expression that is used in this Order and also used in the Regulation has the same meaning in this Order as in the Regulation, other than where the context otherwise requires.

3. This Order applies to a person who, or an undertaking (other than public authorities) that, is classified for statistical purposes under section F of NACE Rev 2 set out in Annex I to Regulation (EC) No. 1893/2006.

4. A requirement on persons or undertakings to which this Order applies -

(a) subject to subparagraph (b), to provide, for the purposes of the survey, information the general nature of which is specified in the Schedule in relation to each quarter in the period from 1 July 2021 to 30 June 2025, and

(b) to provide the information referred to in subparagraph (a) quarterly, and in relation to the immediately preceding quarter, in the period from 1 October 2021 to 30 September 2025,

is hereby prescribed.

SCHEDULE

Article 4

1. Information regarding the following, as it relates to the person or undertaking concerned and specifying the quarter to which the information relates:

(a) the nature of the business;

(b) the number of persons engaged in the undertaking or by the person in the period concerned;

(c) the value of construction work (including the substantial refurbishment of an existing building) done in the period concerned.

2. Information on the time taken by the person or undertaking concerned to complete the questionnaire, form or other record prepared by the Director General for the collection of the information referred to in paragraph 1.
