S.I. No. 531/2022 - Central Mental Hospital (Relocation) Act 2020 (Commencement) Order 2022


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 25th October, 2022.

I, STEPHEN DONNELLY, Minister for Health, in exercise of the powers conferred on me by section 8 (2) of the Central Mental Hospital (Relocation) Act 2020 (No. 28 of 2020) and having consulted with the Minister for Justice, hereby order as follows:

1. This Order may be cited as the Central Mental Hospital (Relocation) Act 2020 (Commencement) Order 2022.

2. In this Order, “Act of 2020” means the Central Mental Hospital (Relocation) Act 2020 (No. 28 of 2020).

3. The 24th day of October 2022 is appointed as the day on which the Act of 2020, other than section 7, shall come into operation.

4. The 13th day of November 2022 is appointed as the day on which section 7 of the Act of 2020 shall come into operation.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order appoints the 24th October 2022 as the day on which all sections of the Central Mental Hospital (Relocation) Act 2020 , except section 7, come into operation. This Order further appoints 13th November 2022 as the day on which section 7 of the Central Mental Hospital (Relocation) Act 2020 comes into operation. This Act provides for the relocation of the Central Mental Hospital from its current location in Dundrum to Portrane, for the transfer of persons lawfully detained in Dundrum to Portrane, and to provide for transitional arrangements during that transfer, for the closure of the Dundrum facility, and for the repeal of section 39 of the Mental Treatment Act 1961 . The repeal of section 39 of the Mental Treatment Act 1961 is contained in section 7 of the Central Mental Hospital (Relocation) Act 2020 , which can only be commenced upon the opening of the new facility in Portrane.
