I, CHARLIE MCCONALOGUE, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by sections 3 and 14 of the Sea-Fisheries and Maritime Jurisdiction Act 2006 (No. 8 of 2006), for the purpose of giving effect to Council Regulation (EU) 2023/194 of 30 January 20231 and Council Regulation (EU) 2023/730 of 31 March 20232 hereby make the following regulations: | ||
1. These Regulations may be cited as the Sea-Fisheries (Quotas) Regulations 2023. | ||
2. (1) In these Regulations “Council Regulation” means Council Regulation (EU) 2023/194 of 30 January 2023 as amended by Council Regulation (EU) 2023/730 of 31 March 2023. | ||
(2) A word or expression that is used in the Council Regulation and is also used in these Regulations, has, unless the context otherwise requires, the same meaning in these Regulations as it has in the Council Regulation. | ||
3. The master of - | ||
(a) an Irish sea-fishing boat wherever it may be, or | ||
(b) a sea-fishing boat in the exclusive fishery limits of the State | ||
shall comply with Articles 8, 13, 15, 16, 17, 18, 22, 25, 26, 28, 31, 32, 33, 35, 36, 38, 39, 40, 41(2), 42, 45, 46, 48 and 55 of the Council Regulation. | ||
4. (1) Subject to paragraph (2), the master of - | ||
(a) an Irish sea-fishing boat wherever it may be, or | ||
(b) a sea-fishing boat in the exclusive fishery limits of the State | ||
shall comply with Article 11(1), (2), (3) and (4) of the Council Regulation in relation to sea bass. | ||
(2) The master of an Irish sea-fishing boat operating in ICES Sub-area 6 or ICES Sub-area 7 is subject to the Bass (Conservation of Stocks) Regulations 2006 ( S.I. No. 230 of 2006 ) in relation to sea bass. | ||
(3) A person engaged in recreational fisheries that is fishing for sea bass shall comply with Article 11(5) of the Council Regulation. | ||
5. The following Regulations are revoked: | ||
(a) The Sea-Fisheries (Quotas) (Deep-Sea Stocks) Regulations 2021 ( S.I. No. 70 of 2021 ); | ||
(b) The Sea-Fisheries (Quotas) Regulations 2022 ( S.I. No. 290 of 2022 ). | ||

(This note is not part of the Instrument and does not purport to be a legal interpretation.) | ||
These Regulations have the purpose of giving effect to the provisions of Council Regulation (EU) 2023/194 (as amended by Council Regulation (EU) 2023/730) fixing for 2023 the fishing opportunities for certain fish stocks, applicable in Union waters and, for Union fishing vessels, in certain non-Union waters, as well as fixing for 2023 and 2024 such fishing opportunities for certain deep-sea fish stocks. | ||
