I, KIERAN O’DONNELL, Minister of State at the Department of Housing, Local Government and Heritage, in exercise of the powers conferred on me by section 176 and section 262 of the Planning and Development Act 2000 (No. 30 of 2000) (as adapted by the Housing, Planning and Local Government (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 408 of 2020 )) and by the Housing, Local Government and Heritage (Delegation of Ministerial Functions) Order 2023 ( S.I. No. 116 of 2023 ), hereby make the following regulations: | ||
Citation | ||
1. These Regulations may be cited as the Planning and Development (Amendment) (No. 2) Regulations 2023. | ||
2. The collective citation “Planning and Development Regulations 2001 to 2023” includes these Regulations. | ||
Definition | ||
3. In these Regulations “Principal Regulations” means the Planning and Development Regulations 2001 ( S.I. No. 600 of 2001 ). | ||
Amendment of Schedule 5, Part 2 | ||
4. Schedule 5, Part 2 of the Principal Regulations is amended: | ||
(a) By the insertion of the following before paragraph (c) : | ||
“(a) Projects for the restructuring of rural land holdings, undertaken as part of a wider proposed development, and not as an agricultural activity that must comply with the European Communities (Environmental Impact Assessment) (Agriculture) Regulations 2011, where the length of field boundary to be removed is above 4 kilometres, or where re-contouring is above 5 hectares, or where the area of lands to be restructured by removal of field boundaries is above 50 hectares. ”. | ||
