I, JACK CHAMBERS, Minister for State at the Department of Transport, in exercise of the powers conferred on me by section 17 of the Sea Pollution Act 1991 (No. 27 of 1991) and the Maritime Transport, Safety and Security (Transfer of Departmental Administration and Ministerial Functions) Order 2005 ( S.I. No. 842 of 2005 ) and the Transport (Delegation of Ministerial Functions) Order 2023 ( S.I. No. 211 of 2023 ), hereby make the following regulations: | ||
1. These Regulations may be cited as the Sea Pollution (Ballast Water Management Convention) (Amendment) Regulations 2024. | ||
2. In these Regulations “Principal Regulations” means the Sea Pollution (Ballast Water Management Convention) Regulations 2023 ( S.I. No. 188 of 2023 ). | ||
3. A reference to the MSO (Marine Survey Office) in the Principal Regulations, other than Regulations 2(1), 16(5), 16(9) and 17, includes a reference to a recognised organisation within the meaning of those Regulations. | ||
4. The Principal Regulations are amended by substituting for Schedule 2 the following Schedule: | ||

2. The operation, maintenance and safety manual; | ||
3. Hazard identification; | ||
4. Environmental and public health impacts; | ||
5. System Design Limitations; | ||
6. Any other relevant information requested by the MSO or recognised organisation acting on its behalf. | ||

These Regulations amend the Sea Pollution (Ballast Water Management Convention) Regulations 2023 ( S.I. No. 188 of 2023 ) to allow for the Marine Survey Office to delegate certain functions in relation to survey and certification to recognised organisations who are recognised in accordance with EU Regulation 391/2009. |
