`THE INDUSTRIAL TRIBUNALS

CASE REF:   5885/09

CLAIMANT:                      Richard Neil Cardy

RESPONDENT:                George Henderson T/a Sharp Print

DECISION

The decision of the tribunal is that the claimant is entitled to a redundancy payment from the respondent calculated on the basis of the information set out at Paragraph 3 below.

Constitution of Tribunal:

Chairman (sitting alone):           Mr D Buchanan

Appearances:

The claimant appeared in person.

The respondent appeared in person.

1.               At the commencement of the proceedings, the title in this matter was amended, by consent of the parties, to that now shown, to reflect the fact that Mr Henderson carried on business as a sole trader under the business name, Sharp Print.

2.               The respondent did not dispute the fact that Mr Cardy had been made redundant and in his response presented on 3 August 2009 stated that he did not intend to resist this claim.

3.

(i)

The claimant worked for the respondent as a printer from 2 June 1997 until 6 February 2009.  He therefore had 11 years’ complete service.

(ii)

He was aged 30 at the time of his dismissal.

(iii)

His gross pay was £220 per week.

(iv)

The appropriate multiplier for calculating his redundancy payment is 91/2.

(v)

His entitlement is therefore £220 x 91/2  =  £2,090.

4.       This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
