DECISION
The tribunal’s decision is that the claimant is entitled to receive redundancy, holiday and notice payments detailed below which total £839.96.

The respondent did not appear and was not represented
1. The claimant, who is now aged 21 years, was employed by the respondent as a Daycare Leader on 17 May 2007.
2. She was paid £660 gross, £596 net, and was owed 5 days holiday at the date of termination, 28 August 2009.
3. The claimant provided the tribunal with a copy of her contract of employment which stated at paragraph 13 that she was entitled to 4 weeks pay in the event of termination of her employment.
4. The claimant’s employment was terminated on 28 August 2009 when the respondent closed the day care element of their business due to financial difficulties. She was subsequently paid for wages owed but did not receive any holiday or notice pay.
5. On the basis of the above, the tribunal finds that the claimant is entitled to receive the following;-
Redundancy Payment: £152.30 x 1 = £ 152.30
Notice pay £137.54 x 4 = £ 550.16
Holiday pay £27.50 x 5 = £ 137.50
Total £839.96

6. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (NI) 1990.
