THE INDUSTRIAL TRIBUNALS
CASE REF: 2241/10
CLAIMANT: Brian Gerard Lavery
RESPONDENT: Sean Ennis
DECISION
The decision of the tribunal (Chairman sitting alone) is that the claimant is entitled to a redundancy payment of £4,940.00 plus £990.00 of unpaid notice pay.
Constitution of Tribunal:
Chairman (Sitting alone): Mr Trevor Browne
Appearances:
The claimant appeared and represented himself.
The respondent did not attend and was not represented.
1. The issue to be determined by the tribunal was whether the claimant was entitled to a redundancy payment.
2. After considering the unchallenged oral and documentary evidence of the claimant, I was satisfied, for reasons delivered orally, that the claimant is entitled to a redundancy payment and to notice pay, calculated as follows:
3. Gross weekly pay at effective date of termination: £379.00
Multiplied by age multiplier (1) x 13 full years’ service = £4,940.00
Plus 11 days’ notice of the twelve owed = £990.00
The respondent is therefore ordered to pay the claimant a total of £5,930.00
4. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
